<p>The Japanese government announced on May 30 that it would officially begin accepting public comments about its cannabis reform bill. One of the proposed measures would potentially loosen restrictions for the use of processing CBD in food products.</p>
<p>In February, the Japanese Ministry of Health, Labour, and Welfare (MHLW) published a proposal hinting changes to the amount of THC allowed in some products. “In order to prevent the occurrence of health and hygiene hazards, a maximum residue limit for THC remaining in trace amounts in cannabis grass-derived products shall be established,” <a href="https://www.mhlw.go.jp/content/11121000/001206962.pdf">MHLW said</a>.</p>
<p><a href="https://astrasana.com/en/team-and-career">AstraSana Holding AG managing director Yves Antoniazzi</a> told <em>Business of Cannabis</em> that the company is in a beneficial position to help the CBD market expand in Japan. “We have been waiting a long time for this,” Antoniazzi said. “It is a huge milestone for the global cannabis industry. Japan is the first country to approve CBD in food, paving the way for corporate companies to list CBD products in retail chains.”</p>
<p>The public comment period will begin now and last through mid to late June.</p>
<p>The Japanese Ministry of Health began discussing medical cannabis legalization back in <a href="https://hightimes.com/news/japanese-ministry-of-health-to-discuss-medical-cannabis-legalization/">May 2022</a>. In October 2023, the Japanese government amended its decades-old Cannabis Control Law. Later in <a href="https://www.japantimes.co.jp/news/2023/11/14/japan/crime-legal/cannabis-bill/?utm_medium=social&amp;utm_source=twitter#Echobox=1699950991">November 2023</a>, Japan’s lower House also passed the bill to move it forward, followed by the House of Councilors passing a revision to the law in <a href="https://hightimes.com/news/japan-amends-cannabis-law-allowing-for-medicinal-products-criminalizing-rec-use/">December 2023</a>. The revision included lifting a ban on cannabis-based pharmaceutical products and also reclassified cannabis under the country’s Narcotics Control Law.</p>
<p>However, it also introduced revised laws regarding illegal use and stated that someone in violation of the law could serve up to seven years in prison. <a href="https://hightimes.com/news/japan-amends-cannabis-law-allowing-for-medicinal-products-criminalizing-rec-use/">Prior to the reformed law</a>, Japan only punished violations for import, export, cultivating, and possession.</p>
<p>A recent report published by <a href="https://www.euromonitor.com/article/key-trends-for-cannabis-in-japan-law-amendments-and-new-opportunities-in-cbd-market">Euromonitor</a> in <a href="https://hightimes.com/news/the-cannabis-market-is-booming-in-japan/">April</a> projects that Japan is poised to experience rapid growth between now and 2028. “Euromonitor International’s latest research in 2023 reveals a staggering growth in the Japan’s cannabis market over the past four years, expanding approximately sixfold from JPY $4 billion (USD $26.3 million) in 2019 to JPY24 billion (USD $173.8 million) in 2023,” the report stated. “This surge is attributed to the rising demand for products offering relaxation, sleep improvement, and stress relief.”</p>
<p>The report explained that previously, Japan hasn’t been a target for cannabis market growth “due to legal uncertainty.” However after the Cannabis Control Law was amended in 2023, it opened up many unique opportunities. “This amendment is expected to significantly change the potential and accelerate the use of cannabidiol (CBD) in diverse fields, including medicine, health, beauty, beverages and edibles in Japan,” the authors wrote. Euromonitor estimated that 0.12% of Japanese people consume cannabis illegally at least once per year, which has led to an increase in both illegal cultivation and processing.</p>
<p>According to <a href="https://english.kyodonews.net/news/2024/03/b770d6f930b7-japan-sees-record-cannabis-cases-in-2023-70-among-young-people.html">Kyodo News</a> in March, 6,482 people were being investigated for involvement in cannabis-related criminal cases in 2023. Numbers from 2022 showed that 5,702 people were involved in the same activity. The National Police Agency noted that this most recent data shows that the number of cannabis-related cases has now surpassed the number of cases involving stimulant drugs for the first time since 1958.</p>
<p>A majority of this illegal activity is centered around an increase in youth involvement, with 3,545 in their 20s and 1,222 younger than 20. Data from 2019 showed that only 609 people under 20 were involved in cannabis-related convictions. The National Police Agency cited the “<a href="https://english.kyodonews.net/news/2024/03/b770d6f930b7-japan-sees-record-cannabis-cases-in-2023-70-among-young-people.html">widespread use of smartphones</a>” and spread of misinformation about cannabis has been the main reason why consumption has increased.</p>
<p>Since 2013, the Osaka Prefectural Police has worked with gaming company Capcom to implement crime prevention awareness in an attempt to decrease youth crime rates. In <a href="https://hightimes.com/news/japanese-police-enlist-video-game-lawyer-to-fight-youth-marijuana-use/">December 2021</a>, the agency partnered with Capcom to utilize characters and imagery from <em>The Great Ace Attorney Chronicles </em>to help deter youth cannabis consumption. “Capcom hopes to support crime prevention activities in Osaka and all of Japan through this program, which will see the production of 6,000 original posters, as well as 4,000 original flyers that will be included with individually wrapped face masks,” Capcom said in a press release. </p>
<p>Japan has had a rich history in hemp cultivation, with the production of CBD with little to no THC being utilized in <a href="https://hightimes.com/news/japanese-police-enlist-video-game-lawyer-to-fight-youth-marijuana-use/">Shinto religious practices</a> since 2016.</p>
<p>In <a href="https://hightimes.com/news/spain-hemp-museum-unveils-new-japanese-themed-exhibit/">June 2022</a>, The Hash Marihuana &amp; Hemp Museum of Barcelona in Spain debuted a special Japanese-themed exhibit entitled “Cannabis Japonica” which was defined as a “fashionable journey through Japan’s cultural ties with the cannabis plant.” The exhibit shared children’s stories about ninjas jumping over hemp plants, which can often grow to be anywhere from nine to 13 feet tall. “This children’s story is a testament to a time when cannabis was ‘big in Japan’. As spring approached, each rural household would plant four to five furrows of hemp seeds. The cultivated hemp was the family’s main source of fibre, used to weave cloth,” the exhibit explained. It also featured unique 120-year-old haiku poetry about hemp, as well as clothing samples and various artifacts.</p>

<p>When you hear the phrase “cannabis tourism,” what comes to mind? A party bus with smoke billowing out of open windows? Scaling the side of a grassy hill to get a glimpse of the cannabis promised land? Perhaps hitting a joint and then gently descending into a child’s pose? All of these are correct. Cannabis-related tourism has evolved quite a bit since the early days of legalization.</p>
<p>When Colorado voters passed adult use in 2012, people from all over the country flocked to the Centennial State to experience something they never had before—consuming cannabis legally. Early cannabis tourism experiences experimented with ideas, which commonly consisted of taking patrons to dispensaries where they could shop and then providing a safe space for them to consume their purchases, which was usually inside a tour bus or an outside venue.</p>
<p>This brand of tourism exists in other markets as well, such as the craft beer market. People sign up for pub crawls where attendees can sample and purchase unique brews. Craft beer tourism also includes dinners with menus to highlight the flavors of the hops, tours of breweries where the beer is being made, as well as art gallery and music events where local, craft beers are showcased. There are even athletic events like Beer Mile, which incorporates both running and beer consumption in competition. So, what does that mean for the future of cannabis tourism?</p>

<h2 id="experiencing-the-culture" class="wp-block-heading"><strong>Experiencing the Culture</strong></h2>
<p>Certain regions in California are known for their wine culture. Napa, Sonoma, and Santa Barbara counties draw millions of people annually who enjoy leisurely strolls through the vineyards, artisan cheeses, and world-renowned wine. It’s a whole lifestyle. Similarly, Kentucky draws bourbon aficionados seeking the finest aged liquor.</p>
<p>While still in its infancy, the cannabis sector of tourism has immense potential. The famed Emerald Triangle of northern California, including Mendocino, Humboldt, and Trinity counties, has a storied and rich history of cannabis cultivation and culture going back decades. Much of the production and cultivation of high-quality cannabis, as seen with today’s most popular strains, took place in those hills. While the stringent framework of cannabis legalization and the opinion of some who believe that cannabis grown outdoors is inferior (as if!) has taken its toll on the economic viability of production in this region, the history and stories are unmatched.</p>
<p>Furthermore, the craft, legacy genetics, and regenerative cultivation techniques applied by farmers in the Emerald Triangle produce cannabinoid and terpene profiles that are complex, therapeutic, and unique to the region. (Here’s a tip: the next time you visit your local California dispensary, ask for something grown outdoors in the Emerald Triangle. You’re welcome.)</p>
<p>Farm tours, farmers’ markets, and cannabis farm-to-table style dinners are just some of the offerings that could be featured in cannabis tourism. However, regulatory barriers like not allowing farmers to sell directly to the consumer or making it difficult to establish a tasting room in the small towns that dot Highway 101 have limited the realization of culture-driven cannabis tourism.</p>
<h2 id="wellness-focused" class="wp-block-heading"><strong>Wellness Focused</strong></h2>
<p>Cannabis yoga was one of the first wellness activities to overtly pair wellness with consumption. Truthfully, many of us have been getting high before experiencing yoga, massages, meditation, and painting for as long as we can remember. However, the concept of marketing these activities with cannabis only surfaced after legalization. While the places where people can publicly smoke cannabis are limited, even in legal states, opportunities to openly consume at private facilities like yoga studios or outdoor venues make them a popular choice among the wellness crowd. As the normalization of cannabis use continues, these offerings may be less in the camp of cannabis tourism and more under the umbrella of wellness in general.</p>

<h2 id="culinary-delight" class="wp-block-heading"><strong>Culinary Delight</strong></h2>
<p>Pairing and integrating cannabis with food is a perfect match, even when many of us, while in the throes of the munchies, have made some suspect food pairing decisions.  I recall one particular night when I was convinced that the peanut butter and easy cheese sandwich I had made was a culinary marvel. Still the fact remains that cannabis has the potential to enhance not only our appetites but also the experience of eating.</p>
<p>Furthermore, like pairing food with wine, the flavors and aromas in cannabis can complement food as well, elevating both the cannabis, the meal, and you! There are two main types of cannabis dinners. The first pairs food with specific strains of cannabis to compliment the flavors and aromas of both and to guide the consumer through the meal in the context of the effects of cannabis. The second infuses meals with THC or other cannabinoids, which puts the focus on a high that evolves throughout the experience. This type of cannabis tourism is very popular among consumers. In the 2023 Consumer Survey from New Frontier Data, 73% of respondents said they would like to attend an infused dinner.</p>
<h2 id="the-future-of-cannabis-tourism" class="wp-block-heading"><strong>The Future of Cannabis Tourism</strong></h2>
<p>Cannabis tourism once focused squarely on giving people who live in illegal states the chance to buy and consume cannabis without fear. As more states have continued to change their laws and more people have access to legal products, not only in their state but also in the neighboring ones, the offerings have shifted to include cannabis as a component of another activity, including cannabis in the context of dining as well as opportunities to experience and learn about legacy cannabis culture. There are many more emerging opportunities in the cannabis tourism space. <p>The clanking of dishes. The terpene-drenched aroma of herbs and savory cuisine. The sweet, dank waft of smoke billowing throughout the air. The laughter. <a href="https://cultivatingspirits.com/" title="">Cultivating Spirits</a>, a three-course cannabis dinner pairing, is about the overall combined experience.</p>
<p>Celebrating its 10th year in operation, Cultivating Spirits provides three-course dinners complete with carefully matched cannabis pairings—the first of its kind to offer such services to the general public in the U.S. The journey began many years ago, and founder Philip Wolf now wears multiple hats as an active mover and shaker in the cannabis industry. He also co-founded the Cannabis Wedding Expo, and launched the recent venture <a href="https://cashom.org/" title="">CashoM</a>, a cannabis masterclass program designed for consumers.</p>
<p><a href="https://www.instagram.com/cultivating_spirits/reels/" title="">Cultivating Spirits</a> events bring together three different strains with three different courses of gourmet dishes that are specifically selected to work in harmony together. Since the process involves smoking rather than infusing the food, guests can choose whether or not they want to participate in the cannabis portion. The team helps diners navigate through the flavorful notes of both the flower and the food, and more importantly, how they will enhance each other. Past dinners include items like chef <a href="https://www.instagram.com/chefjosephl/" title="">Joseph L. Paire III</a>’s spot prawn bisque with green garlic chili oil, paired with Cherry AK, and a crème brulée dessert by chef Tye Idleman, paired with Bazookies.</p>
<p>Since launching Cultivating Spirits, Wolf and his team have curated experiential dining events and provided educated guidance for over 4,000 people. The concept was born from recognizing a glaring need for a better experience that incorporates both fine cuisine and cannabis. Ten years ago, and still to this day, there is no blueprint for running a cannabis pairing event.</p>

<p>“Essentially, I started wanting to create wine-style experiences,” says Wolf. “This was in December of 2013 and it was really deep-seated in my mind.”</p>
<p>Wolf founded a medical marijuana dispensary in Colorado Springs—Colorado Cannabis Caregivers—in 2009 during Colorado’s medical era. Once Colorado voters approved adult-use in November 2012, that’s really when things began to change. Wolf noticed a rising interest in consumers enjoying edibles as the marketplace began to open up.</p>
<p>When designing Cultivating Spirits, instead of infusing dishes with cannabis, Wolf decided to pair cannabis smoking courses like wine.</p>
<p>“This was a period when we [began hosting events involving] smoking and that allowed for the legalities to be easier to operate with more, from a regulatory standpoint, doing it that way as opposed to doing infusions,” Wolf says, speaking of the early days of Cultivating Spirits and noting that if he was infusing foods with cannabis, it would be regulated entirely differently. “Ultimately, at that point, we’re selling cannabis, and we can’t sell cannabis. And there’s also a lot more, there’s obviously more variables [when businesses operate] in that way.”</p>
<p>Cultivating Spirits, depending on the state, partners with nearby cannabis retailers like Colorado-based <a href="https://highcountryhealing.com/" title="">High Country Healing</a>—the flagship store they work with today. When they host dinner pairings in California, it’s entirely different and the businesses are not typically vertically integrated. In California, they’re hosting events for brands, so Wolf works with smaller farms as much as possible there. In 2018, Cultivating Spirits moved into Las Vegas.</p>

<h2 id="upgrading-experiences-with-terpenes" class="wp-block-heading"><strong>Upgrading Experiences with Terpenes</strong></h2>
<p>Wolf wanted to create a new way to fine-tune his dining experiences by way of choosing terpenes to have specific effects and interact with the flavors.</p>
<p>“That’s what I realized was missing,” he says. “At that point, I created the cannabis pairing protocol. And what that is, is [pairing] terpene profiles of cannabis with flavor profiles [of food] to harmonize the flavors. So opposed to a wine where you want to cut that flavor in their mouth, what we were really doing was enhancing and harmonizing flavors.”</p>
<p>Then Wolf discovered that terpenes actually steer the type of mood that cannabis consumers are going to experience, and that’s what creates the feeling. <a href="https://hightimes.com/guides/cannabeginners-what-is-myrcene/" title="">Myrcene</a> is believed to have sedative properties. <a href="https://hightimes.com/health/what-is-limonene-and-what-are-its-benefits/" title="">Limonene</a> is believed energize the mind like espresso.</p>
<p>“Once I realized that, I started studying,” he says. “And that is when I fully dedicated myself to cannabis at that point, because I realized that on the platform of fine dining, that I could teach people how they can identify what type of high they’re going to have, before they even consume.”</p>
<p>He says he wanted people, “to consume something that’s going to enhance their experience and not take away from it while enjoying the culinary arts. Indulging while also being able to not only break bread, with their friends and family at the dinner table, but also through the sharing of smoking.”</p>
<p>One of the perks of pairings versus infusions is the faster onset (depending on how cannabis is infused).</p>
<p>“To me, it was the most brilliant way to present this plant because it gave people a tool that they can use to consciously consume cannabis, as well as it really made for a night of unification and pleasure,” Wolf says. “And so that’s when we really started taking off with these dinners, and once we fully committed to that. And so since then, we’ve done over four hundred events.”</p>
<p>Wolf explained that most of the Cultivating Spirits dinners seat between eight to 14 people. People usually book private events for celebratory experiences like a bachelor-bachelorette party, graduation, wedding, or birthday party. The company also hosts ticketed events held at different locations such as the Claremont Hotel in Berkeley, California. </p>
<p>On January 21, 2015, Wolf organized an invite-only private cannabis dinner on the opening night of X Games Aspen. The event was city approved and became one of the first cannabis consumption events ever authorized by a municipality.</p>
<p>“That night we did a 56-person dinner with five courses,” Wolf says.</p>
<p>Since then, the concept has expanded and been refined. Now Wolf seeks to move away from the limitations of comparing cannabis pairings with wine events. This is why he has mostly retired the word “sommelier” from his vocabulary in recent years. Cannabis can be so much more than just wine culture, he says.</p>

<h2 id="educating-dinner-guests" class="wp-block-heading"><strong>Educating Dinner Guests</strong></h2>
<p>Wolf explains that in general, his patrons are not quite so worried about getting busted by police, as he operates in mature markets in California, Colorado, and Nevada. Instead, they’re more worried about getting too high. Or even worse, being judged for deciding to get high.</p>
<p>“We get a lot of discerning questions from people making sure that they weren’t going to get themselves in trouble. But a lot of them are not worried about getting themselves in legal trouble. It was more like people worried about their photos. And honestly, it was about societal judgments against them from friends, family, neighbors or their job. I felt like that was more of a fear [of getting judged].”</p>
<p>But guess what? Another perk of doing pairings versus infusions is the fact that diners can bring along a friend that doesn’t smoke as the food is separated from the cannabis.</p>
<p>“I would say typically, on average, about 10% of the people on our dinners don’t consume,” Wolf says.</p>

<p>Wolf explains that at the beginning of each dinner, he tells diners that they don’t need to keep smoking after they’re already high.</p>
<p>“It’s important for me, as the steward and server of this plant, to make people understand that this isn’t about mass consumption,” he says. “This is actually about tuning into your body, mind, and soul, and consuming something that’s in alignment with those three areas of yourself, for you to enjoy the best experience around.”</p>
<p>One of his favorite chefs to work with is <a href="https://www.instagram.com/chefjessicacatalano/" title="">Jessica Catalano</a>.</p>
<p>“She’s incredible,” he says. “She totally believes in what we have done. And she’s the one who really first opened me up to terpenes over a decade ago, and ultimately has allowed me to land where I’m at today.”</p>
<p>Catalano used to teach the Cooking with Cannabis class and the Sensational Private Dinners class at Cultivating Spirits. He’s also worked with <a href="https://www.instagram.com/the_herbal_chef/?hl=en" title="">Chris Sayegh, aka The Herbal Chef</a>, and celebrity chefs who wanted to experiment with cannabis infusions such as <a href="https://www.instagram.com/chefhosea/?hl=en" title="">Hosea Rosenberg</a>, Bravo TV’s<em> Top Chef </em>Season 5 winner in 2009.</p>
<p>Throughout all of the dinners, the concept is a focused intention.</p>
<p>“It’s really communion with yourself. What is the why to consuming? What is the purpose? That’s something that I really try to teach people, let’s be intentional,” Wolf says. “Why are we consuming right now? And to me that’s gonna allow for the best experience possible when you are consuming cannabis.”</p>

The hemp-based food market size is expected to reach nearly $8.09 billion USD by 2029 with a compound annual growth rate (CAGR) of 6.9% during the forecast period.</p>
<p>According to a May 9 <a href="https://www.openpr.com/news/3489870/hemp-based-food-market-share-size-segmentation-with">press release</a>, Maximize Market Research forecast significant growth in the hemp-based food sector.</p>
<p>“The study methodology used a mix of primary and secondary research techniques to compile market data,” the report reads. “The primary research techniques, such as questionnaires, interviews, and market observations, would have given the researchers access to first-hand market data, which is usually beneficial. The researchers might have gathered background knowledge and market data by using secondary research techniques including industry studies, business websites, and news articles.”</p>
<p>Hemp-based food market was segmented  by product type: hemp seed oil, hemp protein powder, whole hemp seed, hulled hemp seed (hemp hearts), or others. While the seeds are the main driver of the hemp-based food industry, people have also fried fan leaves and made other snacks out of hemp. </p>
<p>“The study examines the hemp-based food market through a market-focused and commercial analysis that takes into account the market’s revenue, financial situation, portfolio, technical advancements, and mergers and acquisitions. This strategy aids in giving a complete picture of the market, which stakeholders, investors, and market participants may use to create investment strategies and marketing strategies.</p>
<p>Hemp-based foods are celebrated for their nutritional “completeness.” Hemp’s nutritional profile shows that it’s rich in omega fatty acids and gamma-linolenic acid. Even without THC, hemp is believed to have therapeutic properties, such as its antioxidant properties, making hemp-based foods an attractive option for health-conscious consumers. Hemp is a complete protein, containing all nine essential amino acids that people need from food.</p>

<p>The report unveils a comprehensive overview of the hemp-based foods sector. Projected to achieve a robust compound annual growth rate (CAGR) of 8.9%, the market is anticipated to burgeon from its current standing to an impressive $8.36 billion by 2028.</p>
<p>TBRC’s forecast also segmented the hemp-based food industry into similar categories such as whole and hulled hemp seed. TBRC attributes the huge rise in hemp-based foods mostly due to the “explosion” of veganism. As some people switch to a plant-based diet, hemp is a good source of high-quality protein.</p>
<p><a href="https://hightimes.com/news/european-commission-sets-standards-for-hemp-food/">Hemp food standards</a> have been enacted in many jurisdictions due to this rise in popularity. In 2022, the European Commission, the regional body tasked with establishing cannabis regulations across the vertical for all EU members, created <a href="https://hemptoday.net/european-commission-sets-long-awaited-thc-standards-for-hemp-foods/">guidelines</a> for the acceptable amount of THC that can be found in commercially available food products containing CBD—essentially hemp-derived food products.</p>
<p>There are two of them. The first, approved by the <a href="https://hightimes.com/news/european-commission-makes-two-big-steps-on-cbd-reform-front/">EC’s Standing Committee on Plants, Animals, Food and Feed</a>, says that THC levels for hempseed derived oil should be no greater than 7.5mg/kg. The second is that THC levels for dry foods containing hemp, such as hemp seeds themselves as well as flour and protein powder that contain them, can be no greater than 3mg/kg. </p>
<p>Meanwhile, Canada has established a 10mg/kg limit for both oils and dry foods. Switzerland has a limit that is double this at 20mg/kg for oils and 10mg/kg for dry products.</p>
<p>France is also, by far, the largest producer of hemp in the EU (70%), followed by the Netherlands (10%) and Austria (4%). This is also the country where the most effective legal actions at the EU level have so far taken place, and where the most heated battles about regulation of the industry have occurred. This includes the recent court battle to allow the sale of hemp flowers in the country, not just extracts.</p>
<p>Nearly all projects estimate that the hemp-based food industry will soar into the billions by the end of the decade, and the rise will continue as long as people take interest in vegan diets and gluten-free options.</p>

<p>Yet another state is cracking down on hemp-derived products, some of which have intoxicating effects, and South Carolina’s approach to food products that contain hemp is among the most extreme. </p>
<p>The South Carolina Department of Health and Environmental Control (DHEC) issued a warning in <a href="https://scdhec.gov/sites/default/files/media/document/Hemp_Letter_to_Industry.pdf">a letter</a> dated Jan. 22, banning the manufacture, distribution, and sale of food and beverage products containing hemp-derived products as ingredients in the state’s marketplace.</p>
<p>While CBD products can easily be found in most states thanks to a lack of clarity in federal regulations, the U.S. Food &amp; Drug Administration (FDA) has repeatedly warned that products containing CBD are illegal under the Federal Food, Drug, and Cosmetic Act. </p>
<p>The FDA routinely issues warnings that adding CBD to a food means those products are adulterated, or against products with any sort of medical claims, but the agency has delayed finalizing rules.</p>
<p>“Therefore, the following hemp products are NOT APPROVED to be added to food or beverage products,” the letter reads. </p>
<ul>
<li>Viable, non-sterilized hemp seeds, raw hemp leaves, and raw microgreens, and any other raw, unprocessed form of hemp biomass as they are considered “plant material” and may not be possessed without a Grower or Processor License </li>
<li>Pure CBD Isolate </li>
<li>Delta-8 THC, Delta-9 THC, or Delta-10 THC </li>
<li>THC-0 or any other derivative </li>
<li>“Full spectrum” whole-plant extract (i.e. “full spectrum hemp oil/extract” from biomass) if it includes health claims, or bears any sort of declaration of THC or CBD </li>
<li>Any hemp product that is NOT manufactured in a food-grade establishment inspected under GMP or cGMP regulations. </li>
<li>Any hemp or hemp-derived product that promotes its medical or health benefits</li>
</ul>
<p>The only exceptions are basically hemp seed derivatives. “The FDA evaluated three Generally Recognized As Safe (GRAS) notices for hemp products and found that the use of such products as described in the notices is safe. Therefore, the following hemp products may be legally marketed in human foods and are APPROVED to be used as ingredients in food and beverage products,” the letter continues.</p>
<ul>
<li>Hulled hemp seed (<a href="https://www.cfsanappsexternal.fda.gov/scripts/fdcc/?set=GRASNotices&amp;id=765&amp;sort=GRN_No&amp;order=DESC&amp;startrow=1&amp;type=basic&amp;search=hemp">GRAS Notice GRN No. 765</a>; <a href="https://www.fda.gov/media/119427/download?attachment">FDA Response Letter</a>), </li>
<li>Hemp seed protein (<a href="https://www.cfsanappsexternal.fda.gov/scripts/fdcc/?set=GRASNotices&amp;id=771&amp;sort=GRN_No&amp;order=DESC&amp;startrow=1&amp;type=basic&amp;search=hemp">GRAS Notice GRN No. 771</a>; <a href="https://www.fda.gov/media/119426/download?attachment">FDA Response Letter</a>)</li>
<li>Hemp seed oil (<a href="https://www.cfsanappsexternal.fda.gov/scripts/fdcc/?set=GRASNotices&amp;id=778&amp;sort=GRN_No&amp;order=DESC&amp;startrow=1&amp;type=basic&amp;search=hemp">GRAS Notice GRN No. 778</a>; <a href="https://www.fda.gov/media/119428/download?attachment">FDA Response Letter</a>) </li>
</ul>
<p>“While DHEC’s goal is to educate while we regulate this growing niche of manufacturers and distributors of foods and beverages containing hemp-derived products as ingredients, our obligation under the requirements of both federal and state law is to remove from commerce all food and beverage products containing non-conforming hemp-derived products as ingredients,” Sandra Craig, Director of the DEHC’s Division of Food and Lead Risk Assessments, said in a letter announcing the bans.</p>
<p>Sellers can use full-spectrum whole-plant extract as an ingredient in food and beverage products if and only if the hemp-derived ingredient meets the following requirements: </p>
<ul>
<li>A “full spectrum” hemp oil or extract from biomass contains the naturally occurring ratios and array of phytonutrients found in hemp. </li>
<li>Using a full spectrum hemp oil as an ingredient must be referred to in the ingredients list on the food or beverage label as “Full Spectrum Hemp Oil” or “Full Spectrum Hemp Extract.” The label may not contain health claims and may not bear any sort of declaration of “THC”, “CBD”, or “Delta-9” products or isolates. </li>
<li>When companies in South Carolina receive their “full spectrum hemp oil/extract” from their approved supplier, it must contain no more than 0.3% Delta-9 THC, as evidenced by Certificates of Analysis (COAs). The use of concentrates or “work in progress hemp oil from biomass” containing more than 0.3% Delta-9 THC, is illegal. Companies may NOT use “crude” hemp-derived oil, “work in progress” hemp oils over 0.3% Delta-9 THC, non-food grade oils, or dilute hemp oils containing an illegal amount of THC (&gt; 0.3%) to a “legal” level. Hemp products containing more than the legal limit of THC are no longer considered to be hemp but are a Schedule I Drug. Hemp products that contain more than 0.3% THC are NOT ALLOWED to be possessed by anyone in South Carolina, and they are NOT ALLOWED to be introduced into foods or beverages.</li>
</ul>
<p>The letter also bans any mention of THC, dosages, and several other restrictions. The letter also reminds hemp sellers that only intrastate hemp product sales are allowed.</p>
<p>But they’re not only going after hemp-derived cannabinoid products that are synthetically derived from hemp biomass, and known for psychoactive effects—i.e. delta-8 THC, THC-O, etc.—they’re going after products with CBD, hemp leaves, plant material and more as well. Delta-8 THC only appears in nature in minute amounts, and <a href="https://hightimes.com/health/science/cannabeginners-delta-8-delta-9-is-all-thc-created-equal/">intoxicating amounts have to be re-added to hemp via a refluxing process</a> in a lab. This is why states are opting to either crack down on it or regulate it like marijuana. The 2018 Farm Bill opened a legal loophole, accidentally legalizing these ingredients. Delta-8 THC products seeped into the medical markets in some states.</p>
<p>At least a dozen other states are actively pursuing solutions to ban hemp-derived products in one form or another.</p>

<p>The Arkansas Medical Marijuana Commission (AMMC) recently announced the benefits that the state’s medical cannabis program, with millions of dollars in cannabis tax funds helping to provide lunches for kids at school.</p>
<p>While the state has collected $115 million from cannabis taxes, $87 million went toward free or low-cost lunches for children. AMMC spokesperson Scott Hardin explained the breakdown. “A billion dollars has been spent to purchase medical marijuana but what that means for the state is that we’ve collected 115 million dollars in state tax revenue,” Hardin told <a href="https://katv.com/news/local/arkansas-1-billion-medical-marijuana-sales-benefiting-food-insecurity-efforts-across-the-state-medical-marijuana-commission-spokesperson-scott-hardin-recreational-program-dispensaries-national-cancer-institute-tax-profits-health-medicine-medicinal">ABC 7</a>. “From that $115…$87 went to [University of Arkansas for Medical Sciences] specifically as they tried to obtain that National Cancer Institute designation. Now there’s a change. Now that funding is going to go specifically to food insecurity.”</p>
<p>The “low-cost” part of this means kids are paying very little for food. “What that’ll mean is, if someone is on a reduced school lunch, if they are now paying 50 cents to a dollar, that medical marijuana revenue steps in and pays that to ensure that a student gets that for free,” Hardin explained. “So really students in the state will be not having to pay whatever that burden is. 50 cents, a $1.50 to have reduced school lunch so it really is, it’s affecting Arkansans in a positive way.”</p>
<p>The state currently only has eight cultivators and 38 dispensaries, which Hardin said is plenty of storefronts to serve patients and address the current growth pattern. “Unless something changes, unless voters go back to the polls and either accept a modified program or a recreational program or something that’s really where we are,” he said. “The industry itself, you’re not going to see more dispensaries opening up all over the state. You’re not going to see more growers but what we are seeing is more patients. At the beginning of the year we had 89,000 patients. Now we are pushing 100,000.”</p>
<p>Current data, updated as of Dec. 9, shows that there are <a href="https://www.healthy.arkansas.gov/programs-services/topics/medical-marijuana">98,099 patients with active medical cannabis ID cards</a>. According to Hardin, the industry has far outpaced initial projections that the state’s mature market would only have approximately <a href="https://arktimes.com/news/cannabiz/2023/11/29/arkansas-medical-marijuana-sales-surpass-1-billion-since-2019">50,000 active cardholders</a>.</p>
<p>The most recent sales data for November 2023 shows that the state collected $257 million. Arkansas’ medical cannabis program launched in <a href="https://hightimes.com/news/medical-marijuana-sales-arkansas-set-start-mid-may/">May 2019</a>, and between then and October 2023, the state has collected a total of $988.3 million in sales. The combined sales per year breaks down sales from 2019 ($31.2 million), 2020 ($181.8 million), 2021 ($264.9 million), 2022 ($276.3 million), and 2023 ($234 million, but only between January 2023-October 2023).</p>
<p>According to a report from the <a href="https://arktimes.com/news/cannabiz/2023/11/29/arkansas-medical-marijuana-sales-surpass-1-billion-since-2019"><em>Arkansas Times</em></a>, the more accurate number for total sales since medical cannabis began has already surpassed $1 billion. “We’re totally confident we’ve surpassed that,” Hardin said.</p>
<p>According to Arkansas Cannabis Industry Association executive director, Bill Paschall, reaching that $1 billion mark is a sign that cannabis is doing a lot for patients in Arkansas. “It underscores the growing acceptance and recognition of the therapeutic benefits of cannabis and the commitment of the state’s medical cannabis licensees to providing safe, quality and innovative products that meet patients’ needs,” <a href="https://arktimes.com/news/cannabiz/2023/11/29/arkansas-medical-marijuana-sales-surpass-1-billion-since-2019">said Paschall</a>. “The men and women employed by the marijuana industry look forward to continuing to positively impact the lives of Arkansans and contributing to the evolving cannabis landscape.”</p>
<p>Arkansas isn’t the only market hitting $1 billion for cannabis sales. A recent report shows that <a href="https://hightimes.com/business/arizona-weed-sales-exceed-1-billion-in-2023/">Arizona’s recreational cannabis market has also hit $1.1 billion</a> in sales, but includes sales data from just 2023 (specifically, January 2023-September 2023). Arizona’s overall sales data shows a total of more than $billion since it began sales in January 2021.</p>
<p>In legal news, an <a href="https://hightimes.com/news/federal-judge-in-arkansas-blocks-hemp-cannabinoids-ban-in-pivotal-ruling/">Arkansas judge ruled in September</a> that the 2018 Farm Bill takes legal precedence over the state’s ban on hemp-derived cannabinoid products like delta-8. Act 629 of 2023 that passed earlier this year banned delta-8, delta-9, and delta-10 THC products. The lawsuit was filed by four companies (Bio Gen LLC, Drippers Vape Shop LLC, The Cigarette Store LLC, and Sky Marketing Corp) whose lawyers alleged that the ban would harm their businesses. “Plaintiffs have been, and will be, harmed by Act 629, as they are unable to transport in and through Arkansas hemp-derived cannabinoid products that have been declared legal under federal law,” the lawsuit stated.</p>
<p>According to the <a href="https://arktimes.com/news/cannabiz/2023/12/07/judge-plans-to-rule-in-cannabis-advertising-case-by-years-end"><em>Arkansas Times</em></a>, a different ongoing case involves if restrictions on advertising for cannabis businesses is unconstitutional. The lawsuit was filed in 2022 by Good Day Farm, which argued that advertising restrictions violate its right to protected commercial speech. Circuit Judge Chip Welch heard arguments earlier this month, and plans to issue a ruling by the end of the year. <a href="https://arktimes.com/news/cannabiz/2023/12/07/judge-plans-to-rule-in-cannabis-advertising-case-by-years-end">Attorney General Tim Griffin already stated</a> that he plans to appeal the decision, if Welch decides to rule in favor of advertising being too restrictive.</p>

<p>Dispensaries are doing their part to help others to feel the true spirit of thankfulness this Thanksgiving with a round of free turkeys. In recent years, <a href="https://hightimes.com/business/forget-black-friday-its-green-wednesday/">Green Wednesday</a>, which falls on the day before Thanksgiving, has become the cannabis industry’s second-highest grossing day of sales, and a big day for promotional giveaways. Like last year, many cannabis companies are joining the holiday spirit and running their own turkey drives with free turkeys for people in need.</p>
<p>Thanksgiving is a holiday people in the New World have celebrated since 1621, with a feast, and dispensaries can help if you can’t afford it this year. <em>High Times</em> found a handful of dispensaries that are participating in turkey drives this year.</p>
<p>Puff Cannabis Company plans to give away hundreds of free turkeys this week. The Madison Heights, Michigan-based dispensary chain’s second annual Thanksgiving Turkey Giveaway starts today and runs through Friday at Puff stores throughout the tri-county area.</p>
<p>Puff Cannabis founder Justin Elias said they plan to hand out over 2,500 turkeys to people in need—twice the amount of <a href="https://hightimes.com/celebrities/snoop-dogg-announces-hes-quitting-smoking-pot/">free turkeys distributed last year</a>. “The goal of Puff Cannabis Company from the beginning has been to offer top- notch cannabis products while building a knowledgeable and customer- focused team,” Elias said in a statement. “We are honored to have grown to 12 dispensary locations throughout Michigan in only four years, with many locations on tap to open in 2024.”</p>
<p>There are Puff locations across Michigan including in Bay City, Traverse City, Oscoda, Sturgis, River Rouge, Kalamazoo, and Monroe.</p>
<p>Also in Michigan, former Detroit Red Wings Darren McCarthy’s Light’N Up Cannabis Company <a href="https://www.wnem.com/2023/11/09/flint-cannabis-store-is-gifting-1000-turkeys-thanksgiving/">gave away the turkeys last weekend</a>. Of the turkeys, 100 were planned to be given to Vet Life, a local nonprofit organization that serves veterans, and 20 turkeys went to the North End Soup Kitchen and several other Flint area churches and organizations.</p>
<p>“Once you get something like this started, it takes on a life of its own and is more fun and more rewarding each year. The gratitude people express is heartwarming,” <a href="https://www.wnem.com/2023/11/09/flint-cannabis-store-is-gifting-1000-turkeys-thanksgiving/">said</a> Kyle Cohee, store owner. “We’ve been through some tough times here in Flint, and people deserve every single break we can provide. Giving them the central part of a Thanksgiving meal is our honor and our way of thanking the people of Flint for supporting our store.”</p>
<p>MariMed is donating over 800 turkeys in the states where it currently operates, including Massachusetts, Maryland, Illinois, Ohio, and Delaware. “Doing our part to support the communities we serve is an important part of MariMed’s mission to improve people’s lives every day,” <a href="https://finance.yahoo.com/news/marimed-once-again-supports-giving-123000470.html">said</a> CEO Jon Levine. “This is the third consecutive year of our Thanksgiving turkey giveaway, which has become a wonderful tradition that our entire MariMed family rallies behind. We’re proud that we can help ease the financial burden for so many people at this time of year.”</p>
<p>Bulldog Cannabis in Thousand Palms, California is donating 100 turkeys for families in Thousand Palms to have for the Thanksgiving holiday, the dispensary’s annual holiday drive.</p>
<p>The turkeys will be given out from 9 a.m. to 11 a.m. on Wednesday, Nov. 22 to the first 100 families from Thousand Palms.</p>
<p>Supervisor V. Manuel Perez, from the Riverside County Board of Supervisors, spoke on the support by the local business.</p>
<p>“We appreciate Bulldog Cannabis for supporting the community and local families and once again giving back in this way to our unincorporated community of Thousand Palms,” Perez <a href="https://patch.com/california/palmdesert/cannabis-company-donates-free-turkeys-residents">said</a>. “It is a wonderful donation and people are welcome to come by on Wednesday, November 22 and pick up a turkey for the holiday.”</p>
<p>Bulldog Cannabis is the first cannabis business within the unincorporated communities of the Fourth District, and is located in Thousand Palms, the heart of the valley.</p>
<p>Bulldog Cannabis Owner Sam Kapukchyan states, “Bulldog Cannabis is proud to continue the tradition of our turkey giveaway to local Thousand Palms residents. Here at Bulldog, we are all about family caring for others and giving back. Our local Thousand Palms customers have been very loving and supportive of our shop so, on November 22nd, we will be passing out 100 turkeys, one per household to our local Thousand Palms residents, no purchase necessary.”</p>
<p>The turkey giveaway will be a walk-up distribution outside Bulldog Cannabis in Thousand Palms, 72-242 Watt Court.</p>
<p>People who get a turkey should remember to never put a frozen turkey in the deep fryer. That’s why some of the turkey drives are requiring recipients to sign a waiver. They should also make sure that the turkey is completely thawed because oil and water do not mix, and the turkey should thaw in the refrigerator.</p>
