<p>According to government data released this week by the U.S. National Institutes of Health, teen cannabis use stands at historic lows, <a href="https://norml.org/blog/2023/11/17/government-survey-teen-marijuana-use-remains-below-pre-pandemic-levels/">NORML reports</a>. </p>
<p>The data comes from the Substance Abuse Mental Health Services Administration’s (SAMHSA) latest <a href="https://www.samhsa.gov/data/release/2022-national-survey-drug-use-and-health-nsduh-releases">National Survey on Drug Use and Health</a>. And, apparently, just over 11% of kids between the ages of 12 and 17 admitted to having consumed a cannabis product within the last year. Of course, there is always a chance that this figure is higher (pun intended), given that the survey is self-reported. While this number is up from data in 202 and 2021, when teen cannabis use apparently reached historic lows, it clocks in below pre-pandemic (2019) levels.</p>
<p>Meanwhile, the same data shares that 23% of Americans ages 18 and over partook in cannabis during 2022. Over half admitted to having used marijuana at least once in their entire life. </p>
<p>The data is consistent with findings from various other studies that have consistently shown that the implementation of statewide adult-use cannabis legalization has not led to increased rates of youth marijuana use, <a href="https://norml.org/blog/2023/11/17/government-survey-teen-marijuana-use-remains-below-pre-pandemic-levels/">NORML reports</a>. <a href="https://hightimes.com/news/pot-use-lower-among-illinois-teens-who-live-near-medical-dispensaries/">As <em>High Times</em> reported</a>, recent data from Illinois found that teens who live near medical dispensaries are not more likely to partake in cannabis. Doug Smith, the director of the Center for Prevention Research and Development at the University of Illinois Urbana-Champaign, said: “We need to combat the hysteria that legalizing cannabis is going to have a wild and resounding impact on teens in terms of substance use rates and prevalence,” Smith added. “That’s simply not the case.”</p>
<p>And according to <a href="https://norml.org/blog/2023/05/09/federal-report-marijuana-use-by-teens-continues-decade-long-decline/">a report</a> released in May 2023 by the U.S. Centers for Disease Control and Prevention (CDC), there was a significant decline in cannabis consumption among high school students, with a 30% drop in usage from 2011 to 2021. </p>
<p>This period is particularly notable as it coincides with the legalization of cannabis in nearly half of all U.S. states. Additionally, the report reveals a parallel decrease in the number of students who consider themselves current users of cannabis, with the percentage falling by a similar margin. All of such findings show that conservative fear-mongering about adult-use cannabis is wrong. Legalizing marijuana does not lead to increased consumption among teens. </p>
<p>“These findings ought to reassure lawmakers and the public that cannabis access for adults can be legally regulated in a manner that is safe, effective, and that does not significantly impact young people’s consumption habits,” NORML Deputy Director Paul Armentano commented.</p>
<p>During the pandemic, <a href="https://hightimes.com/news/sources-say-cannabis-sales-spiked-during-covid-19-pandemic/">sources say</a> that cannabis use spiked. Everyone was locked inside, afraid, and with little to do but find a way to get by and manage. While there’s nothing wrong with using cannabis, the fact that numbers have reached pre-pandemic levels may indicate that public fears are somewhat calm and have returned to normal. However, there’s a troubling version of what “normal” means in America. Regarding news on cannabis and teens, while they may be using less cannabis than in the year prior, a recent study reveals that California cops are more likely to arrest Black teens. </p>
<p>“Over the past four years, the data collected under the Racial and Identity Profiling Act has provided empirical evidence showing disparities in policing throughout California,” the report states. “This year’s data demonstrates the same trends in disparities for all aspects of law enforcement stops, from the reason for stop to actions taken during stop to results of stop.” </p>
<p>While this data is not explicitly linked to cannabis, according to an October 2022 <a href="https://www.washingtonpost.com/dc-md-va/2022/10/16/virginia-marijuana-enforcement-disparities/"><em>The</em> <em>Washington Post</em></a> story, while the state may have <a href="https://hightimes.com/news/virginia-retail-sales-are-years-away/">legalized adult-use cannabis in July 2021</a>, Virginia police are still more likely to arrest Black people than White folks for cannabis-related offenses. Crime and cannabis are inherently linked. As long as marijuana is illegal on a federal level cops will find a way to weaponize such laws into racist practices. </p>
<p>Recently, around Halloween, headline after headline warned about the dangers of someone underage mistaking regular candy for THC-infused gummies, getting too stoned, and falling victim to everything that <em>Reefer</em> <em>Madness </em>warned about. As <a href="https://hightimes.com/edibles/halloween-warnings-scare-trick-or-treaters-of-weed-edibles-in-fresh-round/"><em>High Times</em> reported</a>, “nothing is scarier than cannabis-infused edibles ‘disguised’ as candy for some parents.” </p>
<p>Citizens concerned about the effects of cannabis and teens would benefit from looking at racist arrest data rather than ruin the fun of Halloween with fear-mongering, in this reporter’s humble opinion. </p>

<p>Republican Study Committee (RSC)—a 156-member GOP House caucus—unveiled the <a href="https://banks.house.gov/uploadedfiles/rsc_family_policy_agenda.pdf">Family Policy Agenda</a> that outlines 14 family-focused principles including the dangers of drugs section, which is entirely about cannabis legalization and how it leads to violent crime and suicide. The overarching goal of the agenda is to “restore the American family.”</p>
<p>Of the 14 principles, 80 legislative recommendations are provided to achieve the GOP caucus’s goals to align with those principles. But the dangers of drug section zeroed in on cannabis—not other drugs like synthetic opioids which the CDC said <a href="https://www.cdc.gov/nchs/pressroom/nchs_press_releases/2021/20211117.htm">accounted for over three-quarters of drug overdose deaths</a> last year.</p>
<p>“Marijuana remains a federally scheduled controlled substance, but that has not stopped more and more states and localities from legalizing it under their own laws,” the Family Policy Agenda reads in the “Protecting Children from Dangers of Drugs” section. “This has led to an explosion of marijuana use among children, which is having a hugely negative impact on their health.”</p>
<p>The agenda continues, “Congress should not legalize marijuana, while also taking steps to constrain this new industry’s ability to harm children. At the very least, Congress should direct the CDC to gather data and conduct studies on the health impacts of THC use during childhood and early adolescence with a special focus on deaths by suicide and those involved in violent crime to provide Congress and the public with further information about these dangers.”</p>
<p>What’s the solution to the dangers of pot? Ridding America of candy-flavored drugs, the agenda says, just ahead of Halloween season when trick-or-treaters are out and about.</p>
<p>“In addition, Congress should pass the <a href="https://www.congress.gov/bill/117th-congress/house-bill/8839?s=1&amp;r=2">Protecting Kids from Candy-Flavored Drugs Act</a>, introduced 3 by RSC Chairman and Congressman Jim Banks (R-IN), which would increase criminal penalties for anyone who manufactures or distributes drugs that are disguised as candy,” the agenda reads.</p>

<p>The RSC, led by Chairman Banks, released an announcement about the agenda as a whole.</p>
<p>“The Biden presidency has failed America’s families,” Chairman Banks wrote in a September 29 <a href="https://rsc-banks.house.gov/news/press-releases/rsc-releases-family-policy-agenda">press release</a>. “Over the past two years, families have lost savings, flexibility, and control over childrearing to increasingly hostile and far left ideologues. Republicans need to position themselves as the party of families. Next Congress we need to focus on reforming the tax code to create more families, passing pro-life legislation, protecting parents’ pocketbooks, and giving them back control over their kids’ education.</p>
<p>“All these policies are popular and proven, and we’ve seen the difference parents can make on election day. If <a href="https://hightimes.com/news/republican-congressmen-push-for-environmental-impact-study-on-cannabis/">Republicans</a> can contrast our efforts with Democrats’ record of intrusion and control then I think parents will play a pivotal role in 2022 and 2024.”</p>
<p>The RSC’s Family Policy Agenda is supported by groups like SBA Pro-Life America and CatholicVote.</p>
<p>Not everyone agrees with the RSC’s particular section on cannabis. For instance, Reps. Tom McClintock (R-CA) and Brian Mast (R-FL) voted affirmatively for the Marijuana Opportunity, Reinvestment and Expungement (MORE) Act, Marijuana Moment <a href="https://www.marijuanamoment.net/house-republican-group-releases-agenda-opposing-legalization-of-marijuana-linking-it-to-suicide-and-violence/">reports</a>.</p>
<p>Others are doing quite the opposite and following the agenda to stop candy-flavored cannabis.</p>
<p>For instance last August, Sen. Chuck Grassley (R-IA) and 24 other GOP members introduced a bill that would ramp up criminal penalties for the production and sale of Schedule I drugs—including cannabis—in the form of candy and beverages they believe are marketed to minors. Under that law, people federally prosecuted for selling cannabis products in the shape or flavor of candy to a minor could face up to 10 years in prison for the first offense, with up to 20 more years for second and subsequent offenses.</p>
<p>Sens. <a href="https://www.congress.gov/bill/114th-congress/senate-bill/724?s=1&amp;r=30">Chuck Grassley</a> and <a href="https://www.feinstein.senate.gov/public/index.cfm/2017/3/feinstein-grassley-introduce-bill-to-combat-candy-and-fruit-flavored-drugs-marketed-to-children">Dianne Feinstein</a> (D-CA) have been re-introducing similar legislation for years, however.</p>

<p>With every Halloween that passes, articles and news coverage warning parents about finding cannabis-infused edibles in their kid’s candy bags are revived. The fact is that these warnings and tall tales, while issued with good intentions, are simply not rooted in truth.</p>
<p>A new <a href="https://www.snopes.com/articles/375420/halloween-marijuana-edibles/"><em>Snopes</em></a> article dug into the <a href="https://hightimes.com/edibles/marijuana-laced-halloween-candy-myth/">myths</a> and origin of this annual charade. While the first state to legalize medical cannabis was California in 1996, cannabis-infused edibles were largely produced as baked goods. At the time, perfecting the art of an infused gummy bear or other recognizable candy was not yet the norm. <em>Snopes </em>ascertains that the topic began to gain attention around 2010, when medical cannabis candies were being advertised in newspapers and other print media. </p>
<p>Scare-tactic stories have real-life consequences. The <a href="https://www.newspapers.com/clip/86974920/the-los-angeles-times/"><em>Los Angeles Times</em></a> reported that law enforcement confiscated cannabis-infused candies from dispensaries on October 30, 2010. </p>
<p>“Investigators have confiscated candies and snacks containing pot from marijuana dispensaries, and they are concerned such items could wind up in children’s trick-or-treat bags… The warning comes days before Californians vote on Proposition 19, the marijuana legalization measure.” The result was a defeated legalization effort, with <a href="https://ballotpedia.org/California_Proposition_19,_Marijuana_Legalization_Initiative_(2010)">53.46 percent of votes not in favor</a> of the Proposition, and 46.54 percent voting in favor.</p>
<p>University of Delaware Professor of Sociology and Criminal Justice Joel Best recently spoke with <a href="https://www.foxnews.com/lifestyle/razor-blades-poisoned-candy-history-halloween"><em>Fox News</em></a> regarding his thorough research on the topic. </p>
<p>“My research stretches back to 1958,” Best shared with <em>Fox News</em>. “I have been unable to find any evidence that any child has been killed or seriously injured by a contaminated treat picked up in the course of trick-or-treating.” </p>
<p>Best authored one study in 1985 entitled “<a href="https://www.jstor.org/stable/800777">The Razor Blade in the Apple: The Social Construction of Urban Legends</a>,” which explored the history of adults giving harmful items to kids on Halloween. His conclusion was that even these events were greatly exaggerated. </p>
<p>“A review of news stories about Halloween sadism from 1958-1983 suggests that the threat has been greatly exaggerated. Halloween sadism can be viewed as an urban legend which emerged during the early 1970s to give expression to growing fears about the safety of children, the danger of crime and other sources of social strain.” Best is also the author of a sociology book called <a href="https://press.uchicago.edu/ucp/books/book/chicago/T/bo3774502.html"><em>Threatened Children: Rhetoric and Concern about Child-Victims</em></a>.</p>
<h3 id="the-real-threats-to-children">The Real Threats to Children</h3>
<p>Of course, we can’t ignore that a small number of children accidentally consume infused candies. However, this fear may stem from a <a href="https://www.newspapers.com/clip/87506643/the-des-moines-register/">tragic incident</a> in which a father put cyanide into his son’s Halloween candy in 1974. Since then, there have been numerous articles sensationalizing the fear of unsuspecting children being harmed by their Halloween candy. <a href="https://www.snopes.com/fact-check/suckered/?collection-id=217876">Drug-laced suckers</a> were a concern in 2000. <a href="https://www.snopes.com/fact-check/ecstasy-halloween-candy/">Ecstasy-laced candies</a> were the urban legend craze of 2015. Just two years ago in 2019, <a href="https://www.snopes.com/fact-check/heroin-sweetarts/?collection-id=217876">heroin-infused SweeTARTS</a> were the topic of discussion. Not one of these examples are confirmed as factual, according to<em> </em><a href="https://www.snopes.com/articles/375420/halloween-marijuana-edibles/"><em>Snopes</em>’</a> research.</p>
<p>Every year, online articles continue to exaggerate the fear of cannabis making its way into the hands of children on Halloween. Headlines such as <a href="https://www.vox.com/2014/10/21/6995119/marijuana-legalization-pot-weed-edibles-candy-food">“Colorado parents are freaking out about marijuana in Halloween candy,”</a> <a href="https://kobi5.com/news/watch-out-for-cannabis-candies-this-halloween-39106/">“Watch out for cannabis candies this Halloween”</a> or <a href="https://www.statesmanjournal.com/story/news/2016/10/31/pot-candy-and-halloween-dangerous-mix/93063288/">“Pot candy and Halloween: A dangerous mix?”</a> perpetuate the urban legend—hijacking people’s existing fears about child safety. </p>
<p>Ultimately, on the topic of cannabis being <em>intentionally </em>placed in kids’ trick-or-treat bags, there is very little evidence of this happening. <em>Snopes</em> does mention an incident that occurred in Nova Scotia in 2019 in which parents found a cannabis edible in their children’s trick-or-treat bags, but there was <a href="https://www.rcmp-grc.gc.ca/en/news/2019/cannabis-edibles-found-childs-halloween-treats">no evidence</a> of it being intentionally placed there, nor was it consumed by the child. In reality, there is a very real problem with vehicular-related accidents on Halloween. According to a <a href="https://www.washingtonpost.com/business/2019/10/28/heres-why-halloween-is-deadliest-day-year-child-pedestrians/"><em>Washington Post</em></a> analysis, Halloween is one of the deadliest days of the year for children pedestrians.</p>
<p>Throughout the rest of the year there has been an increase in accidental consumption of infused edibles by children, which is largely due to 1.) parents not properly securing their edibles away from their children and 2.) the ongoing issue with illegal edibles resembling famous candy brands. Parents should seek out a way to secure their cannabis products, such as something that is tamper- and child-resistant. </p>
<p>Prevention is key in keeping cannabis out of the hands of minors. <p>In regards to the topic of child access to cannabis, and the appeal of illegal cannabis brands advertising under the logo similarities of <a href="https://www.cbsnews.com/news/hershey-wins-trademark-lawsuit-against-colorado-pot-company/">Hershey</a> or <a href="https://www.reuters.com/article/mondelez-gummies-marijuana/stoney-patch-pot-gummies-spur-lawsuit-from-sour-patch-kids-maker-mondelez-idUSL2N24N1LE">Sour Patch Kids</a>, the situation is ongoing. Parents are the first line of defense in keeping their kids away from cannabis, but lawmakers have also enacted legislation over the years to further prevent cannabis edibles from appealing to kids. In Colorado in 2017, <a href="https://leg.colorado.gov/bills/hb16-1436">the state approved House Bill 1436</a>, which banned edibles from being made in shapes that might entice kids.</p>
