<p>Many Pennsylvania residents with nonviolent cannabis offenses will be given a second chance, and the most recent batch of pardons is a promising and much-needed signal of relief.</p>
<p>In a Jan. 12 <a href="https://www.governor.pa.gov/newsroom/gov-wolf-leaves-2540-pennsylvanians-with-second-chances-most-pardons-granted-in-pennsylvania-history/">announcement</a>, Gov. Tom Wolf granted 369 additional pardons, bringing his total to 2,540. Nearly 400 of those pardons were provided under an expedited review process for nonviolent cannabis-related offenses.</p>
<p>“I have taken this process very seriously—reviewing and giving careful thought to each and every one of these 2,540 pardons and the lives they will impact. Every single one of the Pennsylvanians who made it through the process truly deserves their second chance, and it’s been my honor to grant it,” said Gov. Wolf. </p>
<p>“A record prevents positive forward motion in a person’s life, and can spark a repetitive cycle of defeat. I firmly believe that with restored rights, pardoned Pennsylvanians prove themselves by stepping up and giving back to our communities.”</p>
<p>These 2,540 pardons are the most granted by a governor in the history of Pennsylvania. Before Gov. Wolf, Gov. Ed Rendell held the record with 1,122 pardons granted.</p>
<p>Among Gov. Wolf’s pardons, 395 of those were part of the expedited review process for nonviolent cannabis-related offenses and 232 were a part of the <a href="https://www.governor.pa.gov/newsroom/gov-wolf-lt-gov-fetterman-announce-effort-to-quickly-pardon-thousands-of-pennsylvanians-from-marijuana-related-convictions/">PA Marijuana Pardon Project</a>.</p>
<p>In 2019, the Board of Pardons introduced and Lt. Gov. John Fetterman authorized the Expedited Review Program for Nonviolent Marijuana-Related Offenses, a program to speed up the pardon application process for people with nonviolent cannabis possession or paraphernalia convictions. </p>
<p>PA Marijuana Pardon Project is a one-time, large-scale pardoning project for people with select minor, non-violent cannabis criminal convictions. The project is spearheaded by Gov. Wolf and former Lieutenant Gov. Fetterman, and was announced on Sept. 1, 2022, providing a faster way of the process.</p>
<p>“Nobody should be turned down for a job, housing, or volunteering at your child’s school because of some old nonviolent weed charge, especially given that most of us don’t even think this should be illegal,” Fetterman <a href="https://www.governor.pa.gov/newsroom/gov-wolf-lt-gov-fetterman-announce-effort-to-quickly-pardon-thousands-of-pennsylvanians-from-marijuana-related-convictions/">said</a> at the time. Fetterman now serves as U.S. senator from Pennsylvania after assuming office on Jan. 3.</p>
<p>In legal terms, a pardon constitutes total forgiveness by the state for a ​criminal conviction, regardless of whether ​the sentence included time in prison, and allows for expungement of the related criminal record. Applying for a pardon is free for individuals seeking clemency, and the change was made during the Wolf Administration. Under the administration, the pardons process was modernized so that the application process is more streamlined, and the application fees are now waived. The application can be <a href="https://www.bop.pa.gov/Apply%20for%20Clemency/Documents/Application%20Packet_Revised%201-1-22.pdf">downloaded online</a> and the process does not require a lawyer.</p>
<p>A <a href="https://www.bop.pa.gov/Statistics/Documents/plse_bopreport1.pdf">report</a> released in 2020 by the Economy League of Greater Philadelphia—analyzing 10 years of pardons data—found that pardons contributed $16.5 million to Pennsylvania’s economy over the past decade at “no cost to anyone.”</p>
<p>The governor has shown consistent support for cannabis over the past several years, after coming around to it more recently. On Twitter in 2021, Gov. Tom Wolf <a href="https://hightimes.com/news/pennsylvanias-governor-tom-wolf-again-pushes-cannabis-legalization-state/">reiterated his call to end pot prohibition</a> in Pennsylvania. It’s a change in tune for Wolf, <a href="https://www.nbcphiladelphia.com/news/local/governor-tom-wolf-marijuana-recreational-medical-pennsylvania-revenue-legalize-philadelphia/40603/">who in 2017 said</a> that Pennsylvania wasn’t ready to legalize recreational pot use. Two of Pennsylvania’s neighbors, New Jersey and New York, helped push the state into adopting its own cannabis market.</p>
<p>Gov. Wolf has served for two terms in his leadership role. The governor’s <a href="https://www.governor.pa.gov/priorities/">Priorities for Pennsylvania</a> is helping to fuel Pennsylvania’s economic comeback, and the latest round of pardons is helping to further improve his image.</p>

<p>Santa headed southeast from Pittsburg, stopping briefly at the Free Store founded by Gisele Fetterman in Braddock, Pennsylvania, dropping off a load of previously loved bicycles.</p>
<p>He’d followed the calling of service of Gisele since she was a young woman. Relocating to Pennsylvania to work beside her now-husband, John Fetterman, while he was Mayor of the town; then supporting him as Lieutenant General of the state as Pennsylvania’s Second Lady; still by his side today, supporting his successful run as State Senator.</p>
<p>Santa knew a good egg when he saw one, and he couldn’t wait to meet the woman beloved in her state. So loved is she that the mantra, “Vote for Gisele’s husband,” was commonly heard throughout the campaign.</p>
<p>He was also aware she was honest about her medicinal use of cannabis for chronic pain after a series of accidents throughout her life, advocating that her state legalize the plant alongside her husband.</p>
<h2 id="at-home-with-history"><strong>At Home with History</strong></h2>
<p>Santa steered Rudolph toward the rooftop of the Fetterman’s home.</p>
<p>So proud of his state’s history of steel, Sen. Fetterman converted the former Superior Motors building across the street from the Edgar Thomson Steel Works into his family home. The mill was the first to lay railroad tracks across the country, and the pride factor for Fetterman was strong.</p>
<p>Superior Motors was one of the country’s first indoor car dealerships, with an old Chevy needing to be removed via a crane from their soon-to-be-home.</p>
<p>Gisele Fetterman lay next to her sleeping husband thinking about the holiday at hand, her children fast asleep, her husband’s newly-appointed position as State Senator and all that implied for the future of her family and their beloved state.</p>
<p>Not a creature was stirring when she heard a bump in the night on the rooftop.</p>
<p>Glancing over at her husband’s 6’8” frame, giggling at the sight of his feet protruding off the end of the bed, with his head covered by a blanket as he slept soundly, she tiptoed up toward the rooftop to see what was the matter.</p>
<p>Rubbing the sleep from her eyes, she could barely believe what she saw.</p>
<p>“Ho, ho, ho!” didn’t mean to startle you,” Santa said, gingerly stepping down and out of the sled, as the reindeer made themselves comfortable on the expansive rooftop.</p>
<p>“I’m not opposed to miracles,” Gisele said with an unsure smile. “Just give me a minute to take it all in.”</p>
<p>“Well, I’m no miracle, just spreading the love of giving, just like you,” he replied. “My hope is that you are as excited to meet me as I am to meet you. You are one of our people. Your selfless and loving ways have not been missed by my missus either.”</p>
<p>Santa pulled out a small dropper bottle of tincture from his pocket and offered it to Gisele, who was now fondly stroking Rudolph’s nose.</p>
<p>“You probably haven’t thought of this, but my lower back can get a bit sore sitting upon this wooden sled,” he said with a seriousness in his voice that surprised her. “The elves started growing hemp up at the North Pole, and Mrs. Claus makes this tincture. She wanted you to have a bottle.”</p>
<p>The Hemp tincture made by Mrs. Claus, was made using high cannabidiol (CBD) and low tetrahydrocannabinol (THC) compound counts, and was hybridized by the late, great, Lawrence Ringo of Southern Humboldt County at the top of Northern California.</p>
<p>Ringo hybridized low THC plants together for his own chronic back pain, into what he referred to as the “God plant,” as the original cannabis plant said to be found in Holy Anointing Oil from the Bible did not have the high THC count we have today. Yet, the plant referred to as hemp, still has the full cannabinoid and terpene profile of the cannabis plant as a superfood, and highly medicinal without the high.</p>
<p>“Both Frankincense and Myrrh are highly medicinal,” Santa informed. “Not just incense for the Baby Jesus. I don’t think most people understand that about most plants, or why they brought medicine to the child in the manger.” </p>
<p>Gisele understood this and graciously accepted the small bottle with gratitude. But, she was also a bit stunned. It was a lot to take in. Santa, a cannabis advocate – the Elves as farmers, Mrs. Claus an apothecary, weed in Holy Annointing Oil? </p>
<p>This man in a red suit flying through the air offered up more than physical gifts on Christmas Eve, she thought – pondering gifting him extra cookies by the hearth next year.</p>
<p>She also knew in her heart, if her gentle giant of a husband could win State Senate – wearing his signature sweatshirt, perennial shorts in the winter and sneakers, then anything is possible. Hell, her very existence in this life, in this country, was a crapshoot to begin with.</p>

<h2 id="silent-night-holy-night"><strong>Silent Night, Holy Night</strong></h2>
<p>“I read that you have three strikes against you,” Santa continued. “You began your life in this country as an illegal immigrant – you are a woman, and a cannabis patient.”</p>
<p>“Yes, that’s right – with these thick eyebrows, they just don’t know what to make of me,” she laughed, as Santa chuckled along. “But, I believe that education is everything when it comes to cannabis. It’s been misunderstood for a very long time.”</p>
<p>“So many have realized the plant as medicine, it’s true,” he pondered. “When you think about it, I too am illegal. Each year I cross borders for the greater good of making children happy by giving illegally imported gifts! I pay no tariffs. My reindeer aren’t even documented to be in the U.S., but here we are. There are double standards everywhere, in every country.”</p>
<p>The two had a good laugh at Santa’s perspective, and Gisele had to agree, they were quite the pair. </p>
<p>The stars in the sky shined brightly above Braddock, as the two took in this very special Christmas Eve together.</p>
<p>“I’m thankful for you, Santa,” Gisele said lovingly. “And for Mrs. Claus and the Elves – and these beautiful animals. And a plant that helps us both.” </p>
<p>“And I’m thankful for you and your good works,” he repled. <em>“‘If everyone gives, no one goes without.’</em> That’s what Mrs. Claus always reminds me – especially on those days that seem darkest of all. It’s not easy being misunderstood in this world. It’s not easy watching people go without. And it’s not easy watching people suffer in pain, because this plant isn’t available to them. Thank you for your advocacy, Gisele.”</p>
<p>In the distance they could hear the bells of Saints Peter &amp; Paul Byzantine Catholic Church ringing in the blessings of Christmas Eve. The steel mill across the street was quiet, as Gisele’s family slept peacefully in their beds, unaware of the magic taking place up on the roof.</p>
<p>Santa got back up on his sled and commanded his crew to head toward the City of Love, Philadelphia.</p>
<p>“Wish us luck, we are heading right into Kensington,” Santa said with a wave, blowing a kiss to the State Senator’s wife. “Oh, and you have a little surprise at the Free Store, we dropped off some bicycles!”</p>
<p>“God Bless you, Santa – and God bless the souls of Kensington,” Gisele waved back, then put her hands together in prayer, lifting them up to the jolly man. Then she blew a kiss towards him into the twinkling Braddock night sky.</p>
<p>“Merry Christmas to all and to all a good night!” Santa called back.</p>

<p>President Joseph Biden’s historic <a href="https://hightimes.com/news/in-historic-move-biden-announces-he-will-pardon-thousands-of-federal-cannabis-offenses/">announcement</a> that he would pardon all federal marijuana possession convictions and direct administration officials to study easing restrictions on the drug sent shockwaves across the country on Thursday, with activists, cannabis industry officials, pundits, and policymakers all weighing in on the issue. Biden announced the move on Thursday, finally taking the first steps on a pledge while running for office to decriminalize marijuana at the federal level.</p>
<p>“As I often said during my campaign for President, no one should be in jail just for using or possessing marijuana. Sending people to prison for possessing marijuana has upended too many lives and incarcerated people for conduct that many states no longer prohibit,” <a href="https://www.whitehouse.gov/briefing-room/statements-releases/2022/10/06/statement-from-president-biden-on-marijuana-reform/">Biden said in a statement</a> on Thursday. “Criminal records for marijuana possession have also imposed needless barriers to employment, housing, and educational opportunities. And while white and Black and brown people use marijuana at similar rates, Black and brown people have been arrested, prosecuted, and convicted at disproportionate rates.”</p>
<p>The president’s pardons will affect about 6,500 people who were convicted of marijuana possession under federal law and thousands more in the District of Columbia, <a href="https://www.nytimes.com/2022/10/06/us/politics/biden-marijuana-pardon.html">according to a report from <em>The New York Times</em></a>. Biden also called on governors to take similar action at the state level, where the vast majority of cannabis possession charges are filed and prosecuted.</p>
<p>The president also called on the Department of Health and Human Services and the Justice Department to review the continued classification of marijuana as a Schedule 1 substance under the Controlled Substances Act. According to the statute, the Schedule 1 classification is meant for drugs with no medical value and a high propensity for abuse.</p>
<h2 id="pardons-draw-swift-reaction"><strong>Pardons Draw Swift Reaction</strong></h2>
<p>Biden’s announcement caused a flurry of excitement and activity in the cannabis community and beyond, sending marijuana-related stocks surging and spurring predictions on how the move might affect next month’s midterm elections. Pennsylvania Lieutenant Governor <a href="https://hightimes.com/news/john-fetterman-to-push-biden-on-legalizing-cannabis/">John Fetterman</a>, a fellow Democrat and U.S. Senate candidate, urged Biden to decriminalize cannabis when they met in Pittsburgh over Labor Day Weekend. He reiterated his stance after news of Biden’s pardons broke on Thursday.</p>
<p>“People’s lives should not be derailed because of minor, nonviolent marijuana-related offenses. That’s common sense. As Lt. Governor, I traveled across the commonwealth to all 67 counties for a listening tour on the legalization of marijuana,” Fetterman said in a statement. “I heard countless stories from Pennsylvanians about what this simple and just step of decriminalizing marijuana would mean to them. Too many lives—and lives of Black and brown Americans in particular—have been derailed by this criminalization of this plant.”</p>
<h2 id="pundits-ponder-pot-pardons"><strong>Pundits Ponder Pot Pardons</strong></h2>
<p>Political analysis of the pardons announced by the White House on Thursday suggested that the decision could have an influence on next month’s midterm elections, although opinions did not agree on which side would benefit. Some suggested that Biden’s announcement bolsters Republican claims that Democrats are soft on crime, while others believe the move will encourage Democratic and progressive voters to show up at the polls in November.</p>
<p>Former Democratic congressman Beto O’Rourke, who is running for governor in Texas in an effort to turn the state’s executive office blue, issued a statement saying “When I am governor, we will finally legalize marijuana in Texas and expunge the records of those arrested for marijuana possession.”</p>
<p>His opponent, incumbent Governor Greg Abbott, also seized on the president’s announced pardons as a political talking point, rejecting Biden’s call for governors to take similar action at the state level.</p>
<p>“Texas is not in the habit of taking criminal justice advice from the leader of the defund police party and someone who has overseen a criminal justice system run amuck with cashless bail and a revolving door for violent criminals,” Abbott campaign spokesperson Renae Eze said in a <a href="https://www.cnn.com/2022/10/06/politics/biden-marijuana-decriminalization-midterms-analysis">statement quoted by CNN</a>.</p>
<h2 id="pardons-applauded-by-cannabis-community"><strong>Pardons Applauded by Cannabis Community</strong></h2>
<p>Mary Pryor, co-founder of Cannaclusive, a media services company built to facilitate fair representation of minority cannabis consumers through imagery and education, characterized Biden’s pardons as “a major step forward” and urged more progress on comprehensive criminal justice reform to help those harmed by nearly a century of cannabis prohibition.</p>
<p>“Now it’s time to truly dive into restorative harm repair and make sure that access to careers in cannabis or any field is possible for all of those who will be pardoned,” Pryor, who is also a board member of The Parent Company’s Social Equity Fund, said in a statement. “And while this milestone is indeed a major victory, we still need to educate society around the deeper harms of the War on Drugs when it comes to resources and reparative justice.”</p>
<p>Nancy Whiteman, CEO of cannabis edibles manufacturer Wana Brands, applauded the president’s pardons.</p>
<p>“It is incredible news to hear that President Biden is calling for the pardons of prisoners convicted and held on simple federal marijuana possession charges, a move that will impact over 6,500 individuals,” Whiteman said in an email statement. “This is an important step in full decriminalization and a meaningful way to begin to address the racial disparities around the arrests and convictions of BIPOC people.”</p>
<p>Investors viewed Biden’s plan to pardon cannabis possession convictions and reschedule marijuana as an opportunity, sending shares of legal cannabis companies soaring in Thursday’s trading, <a href="https://www.reuters.com/markets/us/cannabis-stocks-surge-biden-overhauls-us-marijuana-policy-2022-10-06/">according to a report from Reuters</a>. Two of the largest publicly traded cannabis companies posted strong gains, with Tilray shares up 22% and the stock price of Canopy Growth jumping 31%. The ETFMG Alternative Harvest ETF, which has shares of several cannabis companies, rose nearly 20%.</p>
<h2 id="not-enough-or-too-much"><strong>Not Enough, or Too Much?</strong></h2>
<p>As can be expected, positive reaction to Biden’s pardons and move to reschedule cannabis was not universal. Many activists and cannabis industry insiders believe the president did not go far enough, while some conservative voices balked at the reforms. Andy Singh, CEO and founder of vape manufacturer Nuvata, said that “President Biden’s statement on the marijuana reform is a long-overdue step in the right direction.”</p>
<p>“However, we have been made these same assurances when he was running for president. At this point, only actions will really be made believable,” Singh wrote in an email to <em>High Times</em>. “It’s been two years since he’s been president, this was one of the very first items he should have addressed as people are unnecessarily suffering in prison daily simply from possession of a plant medicine.”</p>
<p>Dr. Carl Hart, a professor of psychology at Columbia University and the author of the book <em>Drug Use for Grown-Ups</em>, said on social media that the president’s action does not go far enough and suggested political motives are in play.</p>
<p>“While I’m delighted that ~7k ppl will be relieved of MJ possession charges, I’m disappointed that ⁦@JoeBiden⁩ has not taken steps to ensure that no one is arrested for possessing ANY drug. This strikes me as a weak move for votes. Legalize all drugs,” <a href="https://twitter.com/drcarlhart/status/1578133250102497281">Hart tweeted</a> on Thursday.</p>
<p>Senator Tom Cotton, a Republican from Arkansas and staunch “tough-on-crime” conservative, decried the action from the White House.</p>
<p>“In the midst of a crime wave and on the brink of a recession, Joe Biden is giving blanket pardons to drug offenders—many of whom pled down from more serious charges,” <a href="https://twitter.com/SenTomCotton/status/1578116642969714688">Cotton wrote on Twitter</a>. “This is a desperate attempt to distract from failed leadership.”</p>
<p>At the grassroots level, many voters are likely to support Biden’s pardons of federal marijuana convictions. Last year, <a href="https://news.gallup.com/poll/356939/support-legal-marijuana-holds-record-high.aspx">a Gallup poll</a> found that a record-high 68% of Americans are in favor of legalizing marijuana for recreational use.</p>

<p>Held at Temple University in Philadelphia on Sept. 23, the summit <a href="https://fb.watch/fNvzpoxhyY/" target="_blank" rel="noreferrer noopener">examined current cannabis policy</a> in Pennsylvania, both at the state and federal level, as well as the new <a href="https://fb.watch/fNvAnz-EYO/" target="_blank" rel="noreferrer noopener">Cannabis Pardon Program</a>. The event was made possible by <a href="https://www.wearedaco.com/" target="_blank" rel="noreferrer noopener">Diasporic Alliance for Cannabis Opportunities</a> (DACO), as well as <a href="https://www.blackcannabisweek.com/" target="_blank" rel="noreferrer noopener">Black Cannabis Week</a>, which was held between Sept. 18-25. In addition to Sen. Booker, numerous political representatives such as Sen. Sharif Street, Rep. Austin Davis, Rep. Jordan Harris, Rep. Darisha Parker, Rep. Chris Rabb, Former City Councilmember of Philadelphia Derek Green, and City Council member Curtis Jones were invited to participate in the discussion.</p>
<p>At the meeting, Booker explained how progress has been made toward legalization, but there is still work to be done. “With a majority of Americans on both sides of the aisle in support of legalization, we know that this has opportunities,” Booker said. “We need, though, to continue to evolve our focus, our vision, and our strategies to make sure that economically, socially—and especially within our criminal justice system—we are expanding fairness, equality and opportunity.”</p>
<p>He explained that the federal government is lagging behind in embracing legalization nationwide, which is the reason he chose to sponsor the <a href="https://hightimes.com/news/schumer-pushes-back-release-for-senate-legalization-bill/">current Senate Legalization Bill</a> from Majority Leader Chuck Schumer and Senate Finance Committee Chairman Ron Wyden. “We know there is a historic opportunity right now for our country to rectify past wrongs and to create a more just [and] fair America with more opportunity,” Booker said. “There’s still mountains to climb, but I know we will make progress. I know [we] will make it to the mountaintop. I know we will get to a point in this country, because of our labors, where justice rolls down like water and righteousness like a mighty stream.”</p>
<p>The second half of the conference featured the “PA Pardons Process,” which included Sen. Sharif Street as moderator, in addition to Fetterman, Luis Gonzalez of I AM More, Community College of Philadelphia, and Board of Pardons Secretary Celeste Trusty. Pennsylvania’s Marijuana Pardon Project was <a href="https://hightimes.com/news/pennsylvania-announces-program-to-pardon-thousands-of-pot-convictions/">announced on Sept. 1</a> by Pennsylvania Gov. Tom Wolf.</p>
<p>Fetterman, the chair of the program, described the state of Pennsylvania as “a place for second chances,” which will “help people get pardons quickly for stupid weed convictions.” According to Secretary Trusty, over 2,200 residents have applied so far, with 400 having come through just last week.</p>
<p>“This pardon project has the potential to open the door for thousands of Pennsylvanians—the college grad looking to start their career, the grandparent who’s been wanting to chaperone a field trip, or any Pennsylvanian who’s been told ‘no’ for much needed assistance. Now’s your chance,” <a href="https://hightimes.com/news/pennsylvania-announces-program-to-pardon-thousands-of-pot-convictions/" target="_blank" rel="noreferrer noopener">Gov. Wolf said in his initial announcement</a>. He also added that applicants will be notified by Oct. 13 if they will receive a public hearing. Sometime in mid-December, the Board of Pardons will vote on individual cases, and then will recommend the finalists to Wolf for final review.</p>
<p>Those who have a cannabis-conviction on their record have <a href="https://www.bop.pa.gov/Apply%20for%20Clemency/Pages/Expedited-Review-Program.aspx" target="_blank" rel="noreferrer noopener">between Sept. 1-30</a> to submit an application to be pardoned. <a href="https://www.bop.pa.gov/Apply%20for%20Clemency/Pages/Expedited-Review-Program.aspx" target="_blank" rel="noreferrer noopener">Qualifications</a> include convictions relating to possession, intent to distribute small amounts of cannabis, paraphernalia-related offenses and much more. However, <a href="https://www.bop.pa.gov/Apply%20for%20Clemency/Pages/Expedited-Review-Program.aspx" target="_blank" rel="noreferrer noopener">there are a few exceptions</a> that could disqualify an applicant for this limited-time offering, such as being enrolled in a rehab program, being actively on probation or parole, being convicted of driving under the influence of cannabis, and more.</p>

<p>Pennsylvania residents who have previously been busted for cannabis now have a pathway to a clean record.</p>
<p>Gov. Tom Wolf and Lieutenant Gov. John Fetterman, both Democrats, <a href="https://www.governor.pa.gov/newsroom/round-up-gov-wolf-lt-gov-fetterman-announce-commitment-to-pardon-thousands-of-pennsylvanians-from-marijuana-convictions/">announced last week</a> the creation of the “PA Marijuana Pardon Project,” billed as an “effort to quickly pardon thousands of Pennsylvanians from minor, non-violent marijuana-related convictions.”</p>
<p>“This pardon project has the potential to open the door for thousands of Pennsylvanians – the college grad looking to start their career, the grandparent who’s been wanting to chaperone a field trip, or any Pennsylvanian who’s been told ‘no’ for much needed assistance. Now’s your chance,” <a href="https://www.governor.pa.gov/newsroom/round-up-gov-wolf-lt-gov-fetterman-announce-commitment-to-pardon-thousands-of-pennsylvanians-from-marijuana-convictions/">Wolf said in the announcement on Friday</a>.</p>
<p>The governor’s office said that “Pennsylvanians eligible for the opportunity to be pardoned are those with one or both of the following convictions”: “Possession of Marijuana (Title 35 Section 780-113 Subsection A31)”; and “Marijuana, Small Amount Personal Use (Title 35 Section 780-113 Subsection A31I).”</p>
<p>Individuals interested in applying for the program have from September 1 through September 30 to submit their applications online.</p>
<p>“Under the program’s timeline, applicants will be notified by Oct. 13 if they will receive a public hearing. In mid-December, the Board of Pardons will vote on individual cases in public hearings. After the conclusion of the hearings, application recommendations will be made to Wolf for pardons that he will issue prior to departing office in January,” <a href="https://www.governor.pa.gov/newsroom/round-up-gov-wolf-lt-gov-fetterman-announce-commitment-to-pardon-thousands-of-pennsylvanians-from-marijuana-convictions/">Wolf’s office said in the press release on Friday</a>.</p>
<p>Wolf and Fetterman, who is running for U.S. Senate in Pennsylvania this year, said that they were taking the action “in the absence of legislative action on legalization by the Republican-controlled General Assembly.”</p>
<p>“Nobody should be turned down for a job, housing, or volunteering at your child’s school because of some old nonviolent weed charge, especially given that most of us don’t even think this should be illegal,” Fetterman said in the press release.</p>
<p>Fetterman, who is running against Republican nominee Mehmet Oz (AKA “Dr. Oz”) in the Senate race, is a vocal champion of marijuana legalization.</p>
<p>Last week, ahead of President Biden’s Labor Day visit to Pittsburgh, <a href="https://hightimes.com/news/john-fetterman-to-push-biden-on-legalizing-cannabis/">Fetterman urged the White House to take action on cannabis reform</a>.</p>
<p>“It’s long past time that we finally decriminalize marijuana,” Fetterman said in a statement. “The president needs to use his executive authority to begin descheduling marijuana, I would love to see him do this prior to his visit to Pittsburgh. This is just common sense and Pennsylvanians overwhelmingly support decriminalizing marijuana.”</p>
<p>That position makes for a stark contrast with Oz, who has said he is opposed to cannabis legalization, and whose campaign has mocked Fetterman’s pot-friendly policies.</p>
<p>In an ad released last month, the Oz campaign slammed Fetterman’s position on marijuana, and depicted a bong coming out of the Democratic candidate’s head.</p>
<p>“There are not enough Pennsylvanians to work in Pennsylvania,” Oz <a href="https://www.youtube.com/watch?v=_ikLCHqD4Nw">said</a> in an interview with Newsmax in May, “so giving them pot so that they stay home is not, I don’t think, an ideal move….We need to get Pennsylvanians back at work, gotta give them their mojo, and I don’t want marijuana to be a hindrance to that.”</p>
<p>Fetterman, meanwhile, has not equivocated on the issue.</p>
<p>“I don’t want to hear any bull— coming out of Dr. Oz’s campaign trying to conflate decriminalizing marijuana with seriously harmful crime,” Fetterman <a href="https://www.post-gazette.com/news/politics-state/2022/09/04/fetterman-decriminalize-marijuana-pittsburgh-labor-day-parade-pot-policy-president-biden/stories/202209010025">said</a> in a statement, as quoted by the <em>Philadelphia Inquirer</em>. “Are we supposed to believe that neither he nor any members of his staff have ever used marijuana? … I know firsthand what real crime looks like. Marijuana does not fit the bill.”</p>
<p>Cannabis reform advocates praised Wolf and Fetterman for the pardon program.</p>
<p>“It’s a good example of Gov. Wolf and Lt. Gov. Fetterman doing everything they can from the executive office on this issue,” Chris Goldstein, NORML’s Pennsylvania, New Jersey and Delaware regional organizer, said in the press release last week.</p>

<p>John Fetterman, who is currently a U.S. Senate <a href="https://hightimes.com/news/politics/pa-lt-gov-john-fetterman/" target="_blank" rel="noreferrer noopener">candidate</a> wants to hold President Joe Biden <a href="https://twitter.com/JohnFetterman/status/1564355965092249601?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1564355965092249601%7Ctwgr%5Ee5e10712352efcd73bb4503f7ab22c5f2a4210e1%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.marijuanamoment.net%2Ffetterman-plans-to-press-biden-on-need-to-finally-decriminalize-marijuana-at-labor-day-parade%2F" target="_blank" rel="noreferrer noopener">accountable</a> for one of his most important campaign promises—cannabis reform. </p>
<p>Fetterman, a big cannabis advocate, claims that if he is elected to the Senate, he will keep pushing for cannabis reform. But before then, he intends to appeal to the president directly at a Labor Day parade in Pittsburgh on September 5, when he marches with the president.  </p>
<p>“It’s long past time that we finally decriminalize marijuana,” Fetterman said in a press release on Monday. “The president needs to use his executive authority to begin descheduling marijuana, I would love to see him do this prior to his visit to Pittsburgh. This is just common sense and Pennsylvanians overwhelmingly support decriminalizing marijuana.”</p>
<p>Fetterman’s campaign spokesman says he is planning to bring up these issues at the parade when they march together. According to their statement, the lieutenant governor “looks forward to talking to the president there about the need to finally decriminalize marijuana.” </p>
<p>Biden so far has not made good on these campaign promises regarding cannabis. He made his first comments on the issue since taking office last month when he was pressed on the issue, and finally spoke out about folks who are incarcerated for nonviolent cannabis crimes. He claimed his administration is “working on” that promise and mentioned a crime bill addressing the issue might be in the works. </p>
<p>Fetterman isn’t the only person pushing Biden in this direct. Six senators—including Sens. Elizabeth Warren (D-MA), Bernie Sanders (I-VT), and Cory Booker (D-NJ)—sent a letter to Biden in July asking for action to be taken so that clemency could finally come to non-violent federal cannabis prisoners. </p>
<p>The letter claimed that the administration is “harming thousands of Americans, slowing research, and depriving Americans of their ability to use marijuana for medical or other purposes.”</p>
<p>Back in Pennsylvania, current polling puts Fetterman ahead of his Republican opponent, the TV health personality Mehmet Oz, better known as Dr. Oz. Both Oz and the Republican National Committee <a href="https://www.marijuanamoment.net/dr-oz-attacks-fettermans-popular-marijuana-legalization-stance-in-pennsylvania-senate-race-despite-previously-endorsing-reform-himself/">have taken aim at the Democratic nominee</a> over his cannabis and drug policy reform record, despite polling that shows most of Pennsylvania supports Fetterman’s positions on legalization and harm reduction.</p>
<p>Facing off against the more conservative Dr. Oz in Pennsylvania for the Senate spot, and so far, he has been very outspoken about his support of legal cannabis and drug reform. He has commented that he sees the success of cannabis sales in nearby New Jersey and wants the same for his home state of Pennsylvania. Meanwhile, he sees that folks from his state and others are still in prison for cannabis. </p>
<p>One of his goals in his role currently is to ensure that many eligible folks get pardons, and he serves on the Board of Pardons in Pennsylvania. He would like to see the courts remove cannabis arrests from records and restore opportunities like housing, student financial aid, and employment. </p>
<p>Fetterman spoke out favorably when Pennsylvania Gov. Tom Wolf (D) endorsed marijuana legalization, as well as led a statewide listening tour to talk about cannabis and how the state’s residents feel. He says he is committed to the work needed to “legalize weed for jobs, justice, veterans, farmers and revenue,” according to a fundraising email early this year.</p>
<p>He has also been known for boastful remarks about Pennsylvania cannabis farmers, claiming they can grow better cannabis then people in New Jersey, as a way to light the fire for cannabis reform. In 2020, he also hosted a virtual forum to get advice from legal states about state legalization. </p>
<p>It’s not clear how his message will be received at the parade, but on behalf of the country’s cannabis advocates, we say good luck Fetterman!</p>
