<p>New Jersey Senator Cory Booker paid a visit to Natura, Sacramento on Monday to take a look at some grow rooms and talk about cannabis.</p>
<p>Senator Booker didn’t have long to talk but he greeted a room full of weed people with a smile and accolations for those who have taken legal and personal risks to pioneer the industry and set the standard for the rest of the states still in the early days of their legal markets.</p>
<p>“We’re in a weird place in our country where we’ve had this prohibition that has lasted for generations that has really punished folks,” Senator Booker said Monday. “I’m from Newark where marijuana enforcement is disproportionately focused on low income people, people of color, people who are suffering, people who are struggling. And we have this perverse reality in America where we have people with criminal convictions who are doing things that presidents and congress people and senators have admitted to doing. The hypocrisy of that is maddening.”</p>
<p>A long time advocate of legal cannabis, Senator Booker recently introduced the Cannabis Administration and Opportunity Act with Senator Chuck Schumer of New York and Senator Ron Wyden of Oregon. If passed, this bit of legislation would essentially end federal cannabis prohibition by removing cannabis from the list of controlled substances entirely.</p>
<p>“Thousands of people have suffered at the hands of our broken cannabis laws, and the Cannabis Administration and Opportunity Act would finally dismantle the outdated federal marijuana prohibition, expunge past convictions for people with low-level cannabis offenses, and ensure restorative justice for communities impacted by the War on Drugs,” Senator Booker said in a <a href="https://www.booker.senate.gov/news/press/booker-schumer-wyden-lead-reintroduction-of-cannabis-administration-and-opportunity-act-legislation-to-end-federal-prohibition-of-cannabis">press release</a>. “These common-sense policies will ensure a more equitable criminal justice system and promote public safety.”</p>

<p>The announcement of the Cannabis Administration and Opportunity Act came almost directly after an announcement by the DEA to reschedule cannabis from Schedule 1 alongside drugs like heroin and LSD to Schedule 3, alongside drugs like Xanax, Codeine and Ketamine. While rescheduling certainly represents a step forward with regard to the federal laws regarding cannabis, it would not necessarily do anything for people serving prison time for federal cannabis infractions. It’s also unclear how rescheduling would affect existing state cannabis markets, though speculation has run rampant to that end since rescheduling was announced.</p>
<p>The Cannabis Administration and Opportunity Act contains provisions to create uniform federal regulations for cannabis through the establishment of a federal regulatory commission for cannabis as well as directions for the FDA to establish standards for labeling of cannabis products. The act would also secure additional funding for substance abuse recovery programs, establish grant programs to help individual states combat black market cannabis operations, and direct the Department of Transportation to collect data on cannabis-impaired driving. There are provisions in the act to, among other things, do away with tax burdens on legal cannabis businesses, remove cannabis from federal drug testing, provide automatic expungement for non-violent cannabis crimes, and require various federal agencies to spend money studying cannabis. The bill is co-sponsored by 15 additional Democratic senators and the full text can be found <a href="https://www.booker.senate.gov/imo/media/doc/caoa.pdf">here</a>. </p>
<p>“It’s past time for the federal government to catch up to the attitudes of the American people when it comes to cannabis,” Leader Schumer said in a press release. “We have more work to do to address decades of over-criminalization, particularly in communities of color, but today’s reintroduction shows the movement is growing, and I will keep working until we achieve meaningful change.”</p>
<p>This is not the first time Senator Booker has attempted to push legislation to decriminalize cannabis production. He said Monday that when he made his first attempt to do so as a congressman, he was laughed at by his fellow senators.</p>
<p>“I’ve been in the trenches on this. When I first got to the senate 11 years ago, I put forth a major piece of legislation called the Marijuana Justice Act, and I’m not joking I literally got laughed at by senators saying that we shouldn’t do that or it’s a career ender to come out like that,” Senator Booker said. “But now the world has changed in over a decade. The red states and blue states all around America, some partisan issue, have come forward and say, no. This is ridiculous. I’ve had law enforcement officers say ‘Gosh, if there was a drug I’d want to ban it would be alcohol not marijuana.’”</p>
<p>Senator Booker’s visit to Natura was brief but served as yet another indicator that the times are a-changing in Washington and cannabis is moving away from its long-time status as the poster child of the drug war and moving toward a much more realistic and less harmful spot in the eyes of our national legislators. Senator Booker expressed his admiration for the people who have been willing to work in the cannabis industry while it goes through its post-prohibition growing pains.</p>
<p>“I came here to, not learn, but connect with these people that are part of a larger movement in America for justice and I’ve just seen that each and every one of you are willing to work in an industry that’s not easy, but also wants to be in a country where freedom’s never been easy,” Senator Booker said. “Justice has never been easy but we need people like us to stand up for it. It’s what makes it possible.”</p>

<p>A New York state senator wrote a letter to the state’s Office of Cannabis Management, urging leadership to engage in “aggressive action” on unlicensed cannabis retailers after witnessing them in his own neighborhood.</p>
<p>State Senator Brad Hoylman-Sigal, chair of the Senate Judiciary Committee, and representing New York’s 47th State Senate District on Manhattan’s West Side, is tired of unlicensed cannabis stores and dispensaries popping up across town.</p>
<p>Hoylman-Sigal wrote a <a href="https://www.nysenate.gov/newsroom/articles/2023/brad-hoylman-sigal/senator-hoylman-sigals-letter-office-cannabis-management">public letter</a> on July 17, addressed to Office of Cannabis Management Executive Director Christopher Alexander and Tremaine Wright, chair of the Cannabis Control Board, urging action immediately.</p>
<p>“In the 2023 budget, the New York State Legislature granted additional authority to the Office of Cannabis Management (OCM) and the Department of Taxation and Finance (DTF) to address unlicensed cannabis stores,” Hoylman-Sigal wrote. “This includes conducting inspections, imposing civil penalties, and seeking injunctions to shut down stores. I am grateful to see OCM and DTF begin to take action. Given the serious issues caused by these stores, I urge OCM and DTF to continue to act quickly and aggressively to shut down these unlicensed stores.”</p>
<p>Hoylman-Sigal addressed the severity of the issue, including stores dotting Manhattan. </p>

<p>“The scale of these unlicensed stores is staggering, with over 100 stores identified in Hell’s Kitchen alone. As I have <a href="https://www.nysenate.gov/newsroom/articles/2022/brad-hoylman-sigal/letter-illegal-cannabis-shops">expressed previously</a>, these stores are deceptive to consumers, hazardous to public health, cheating on their taxes, undermining the State’s equity-based and legal cannabis rollout, and have little incentive to inspect IDs to ensure they are not selling to minors. Additionally, because these stores are unregulated and have little oversight, they pose a danger to employees and neighbors.”</p>
<p>Hoylman-Sigal went a step further to name dispensaries that are either unlicensed or have received complaints.</p>
<p>“I am enclosing a list of stores which have been reported to us by constituents as well as a list of unlicensed stores in Hell’s Kitchen compiled by the Hell’s Kitchen Neighborhood Coalition. I urge OCM to act expeditiously to shut down these stores.”  </p>
<h2 id="new-york-takes-action-on-the-proliferation-of-unlicensed-cannabis-shops" class="wp-block-heading"><strong>New York Takes Action on the Proliferation of Unlicensed Cannabis Shops</strong></h2>
<p>New York Gov. Kathy Hochul is also ramping up efforts to tackle the illegal dispensary situation.</p>
<p>New York State Office of Cannabis Management and Department of Taxation and Finance began inspections of unlicensed shops in early June under a new law signed by Gov. Hochul a month prior in May.</p>
<p>The <a href="https://www.governor.ny.gov/news/governor-hochul-signs-legislation-curb-illicit-cannabis-market-new-york-state-part-fy-2024">new law</a> signed by the Governor in May is part of the State’s Fiscal Year 2024 Budget. The beefed up penalties include fines of up to $20,000 per day, used to discourage illegal activity.</p>
<p>“Under new powers that I fought for in this year’s State budget, we can now conduct enforcement against businesses illegally selling cannabis, and I’m proud to report that in just the first three weeks of our efforts, we’ve seized nearly $11 million worth of illicit products off the streets,” Governor Hochul said. “These unlicensed businesses violate our laws, put public health at risk, and undermine the legal cannabis market, and with the powerful new tools in our toolbelt we’re sending a clear and strong message: if you sell illegal cannabis in New York, you will be caught and you will be stopped.”</p>
<p>The New York City Council is also stepping in. At a meeting of the New York City Council last January, <a href="https://hightimes.com/news/nyc-city-council-pledges-action-on-unsolicited-pot-shops/">officials pledged increased enforcement against unlicensed cannabis retailers</a> and said that the state legislature is drafting new legislation to give law enforcement additional powers to shut down illicit pot shops. For the time being, unlicensed stores are easy to find in the state.</p>

<p>Democratic Senator John Hickenlooper of Colorado on Thursday introduced legislation designed to prepare the country for national cannabis legalization, laying the groundwork for drafting regulations to govern legal marijuana at the federal level. The bill, the Preparing Regulators Effectively for a Post-Prohibition Adult Use Regulated Environment (PREPARE) Act, directs the U.S. attorney general to develop a regulatory framework to be in place for the eventual federal legalization of cannabis by Congress, which is likely inevitable as the popularity of cannabis policy reform continues to grow.</p>
<p>Hickenlooper was the governor of Colorado when voters legalized recreational marijuana with the passage of Amendment 64 in 2012. A month later, he convened the Amendment 64 Task Force to provide recommendations for the establishment of regulations that set the stage for Colorado’s successful legal cannabis industry. Last month, 10 years after Amendment 64 was approved by Colorado voters, Hickenlooper revealed that he planned to introduce the bipartisan PREPARE Act to create a similar commission at the federal level. </p>
<p>“A decade after Colorado pioneered marijuana legalization, Americans overwhelmingly support the same at the federal level,” <a href="https://www.hickenlooper.senate.gov/press_releases/hickenlooper-introduces-bill-to-prepare-for-marijuana-legalization/">Hickenlooper said</a> in a statement from the senator’s office. “This bipartisan, bicameral framework, based on Colorado’s Amendment 64 Task Force, will replicate our success nationally.”</p>
<h2 id="companion-measure-to-house-bill"><strong>Companion Measure To House Bill</strong></h2>
<p><a href="https://www.hickenlooper.senate.gov/wp-content/uploads/2022/11/SIL22907.pdf">Hickenlooper’s legislation</a> is a companion bill to a House version of the measure sponsored by Representative Dave Joyce, a Republican from Ohio.</p>
<p>“I’m thrilled that the PREPARE Act has been introduced in the Senate, making it not only further bipartisan, but bicameral, and bringing it one step closer to becoming law,” said Joyce. “This legislation gives lawmakers on both sides of the aisle the answers they need to effectively engage on cannabis reform, safely and effectively regulate it, and remedy the harms caused by the failed war on cannabis.” </p>
<p>“With those answers, Congress can develop a much-needed federal regulatory framework that not only respects the unique needs, rights, and laws of each state, but also ensures a responsible end to prohibition and a safer future for our communities,” he continued. “I was proud to lead the introduction of this commonsense bill in the House and thank Senator Hickenlooper for advancing it in the Senate.”</p>
<p>The bill directs the attorney general to establish a “Commission on the Federal Regulation of Cannabis” to advise on the development of a regulatory framework, which would be modeled after existing federal and state regulations for alcohol. The 24-member commission would consist of representatives from relevant government agencies and offices, individuals nominated by Senate and House leadership and individuals nominated by other government agencies.</p>
<p>The legislation requires the plan developed by the commission to account for the unique needs, rights and laws of each state, and directs the commission to present the plan to Congress within one year of enactment of the PREPARE Act. The commission would not have rulemaking authority. The panel’s only role would be to develop proposals and make policy recommendations.</p>
<p>The regulatory framework developed by the commission would be required to include “ways to remedy the disproportionate impact cannabis prohibition has had on minority, low-income and veteran communities; encourage research and training access by medical professionals; encourage economic opportunity for individuals and small businesses; and develop protections for the hemp industry,” according to Hickenlooper’s office.</p>
<h2 id="growing-support-for-cannabis-policy-reform"><strong>Growing Support For Cannabis Policy Reform</strong></h2>
<p>Hickenlooper’s bill highlights the growing support for cannabis policy reform in the United States. In October, President Joseph Biden announced he would <a href="https://hightimes.com/news/in-historic-move-biden-announces-he-will-pardon-thousands-of-federal-cannabis-offenses/">pardon all federal convictions</a> for simple marijuana possession, and last week a <a href="https://hightimes.com/news/new-poll-shows-9-out-of-10-americans-support-legal-pot/">new Pew Research poll</a> found that 90% of Americans favor legalizing cannabis in some form.</p>
<p>“President Biden recently—and correctly—declared the federal government’s categorical criminal ban on cannabis a failure and urged executive leadership at the state and federal levels to take concrete steps to bring about rational reform,” Shane Pennington, an attorney with the cannabis and psychedelics law firm Vicente Sederberg LLP, wrote in an email to <em>High Times</em>. “The PREPARE Act seeks to ready the federal government for the far broader reforms, which are now imminent. Undoing decades of inane cannabis laws and regulations will require a coordinated and concerted effort at every level of government and among countless federal agencies. The PREPARE Act would lay the necessary groundwork to ensure that the federal government carries out legalization in a fair, efficient, and effective manner.”</p>
<p>Khadijah Tribble, the CEO of the trade group the US Cannabis Council, said the “Biden administration’s review of cannabis scheduling, midterm ballot measures, and polling on cannabis decriminalization all signal that the end of cannabis prohibition isn’t just inevitable — it’s imminent. <p>A Louisiana politician who is running for a congressional seat is appealing to voters by showcasing his own personal cannabis use while addressing the failed War on Drugs. Louisiana Senate candidate <a href="https://twitter.com/GaryChambersJr?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1483424500712673283%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.marijuanamoment.net%2Fu-s-senate-candidate-smokes-marijuana-blunt-in-campaign-ad-about-harms-of-criminalization%2F">Gary Chambers</a>, released the video on <a href="https://www.youtube.com/watch?v=Qj_FD25oREY&amp;ab_channel=GaryChambersJr.">YouTube entitled “37 Seconds”</a> to sum up the problems with the War on Drugs and the need for social justice now—all while sitting in a chair smoking a blunt.</p>
<p>“Every 37 seconds, someone is arrested for marijuana. Since 2010, state and local police have arrested an estimated 7.3 million Americans for violating marijuana laws, Over half of all drug arrests,” <a href="https://www.youtube.com/watch?v=Qj_FD25oREY&amp;ab_channel=GaryChambersJr.">he says in the video</a>. “Black people are four times more likely to be arrested for marijuana laws than white people. States waste $3.7 billion enforcing marijuana laws every year. Most of the people police are arresting aren’t dealers, but rather people with small amounts of pot, just like me.”</p>

<p>Chambers expresses his confidence that he can stand up for the cannabis consumers of Louisiana if he becomes a Senate representative. “I hope this ad works to not only destigmatize the use of marijuana, but also forces a new conversation that creates the pathway to legalize this beneficial drug, and forgive those who were arrested due to outdated ideology,” Chambers <a href="https://twitter.com/GaryChambersJr/status/1483424500712673283?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1483424500712673283%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.marijuanamoment.net%2Fu-s-senate-candidate-smokes-marijuana-blunt-in-campaign-ad-about-harms-of-criminalization%2F">wrote on social media channels</a>. </p>
<p>Chambers announced his run for U.S. Senate on <a href="https://twitter.com/GaryChambersJr/status/1481265585879240705">January 12</a>, citing the need for change. “I’m running for the U.S. Senate because Louisiana continues to be ranked last in the nation. That is more a reflection of our leaders than our people,” he wrote of the current regime. Furthermore, he pointed out that it has been 149 years since a Black man served in the “statewide office” in Louisiana. The last Black man, <a href="https://twitter.com/GaryChambersJr/status/1481858748385796096?ref_src=twsrc%5Egoogle%7Ctwcamp%5Eserp%7Ctwgr%5Etweet">P.B.S. Pinchback</a> was governor of the state between December 9, 1872 through January 13, 1873. “Let’s not wait another 100 years before another Black person is elected statewide in Louisiana.”</p>
<p>In the past, Chambers has made himself known as an advocate for social justice. In March 2021 he ran for a seat in the U.S. House of Representatives, but lost in the special election to <a href="https://troycarter.house.gov/">Troy Carter</a>. He also shared his support both for the <a href="https://www.congress.gov/bill/117th-congress/house-bill/6129/text?r=167&amp;s=1">Harnessing Opportunities by Pursuing Expungement</a> (HOPE) Act, as well as the <a href="https://www.congress.gov/bill/117th-congress/house-bill/1996">Secure and Fair Enforcement (SAFE) Banking Act</a>.</p>

<p>Chambers’ video is a brief but bold display of the reality of cannabis in a modern age, and the drawbacks that the stigma still perpetuates. However, he isn’t the only politician who has embraced cannabis to appeal to voters. </p>
<p>In 2019, a Illinois House candidate <a href="https://twitter.com/anthonyvclark20?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1197960779280113669%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.marijuanamoment.net%2Fcongressional-candidate-smokes-marijuana-and-talks-legalization-in-campaign-video%2F">Anthony Clark</a> smoked a joint while discussing the need for honesty. “I think I have to be just as open about my cannabis use, you know? Because lying to individuals, I think, plays a direct role in enabling status quo, in enabling the oppressors, the top one percent, to remain,” <a href="https://www.facebook.com/anthonyvincentclark/videos/2499010153707685/">Clark said in an interview</a>. “We have to empower ourselves. We have to educate ourselves. I don’t hide this at all. I tell people on a daily basis, cannabis saved my life, it continues to save my life.”</p>
<p>Likewise, the presence of cannabis is being used elsewhere to help educate and normalize cannabis for other lawmakers. A Mississippi legislator <a href="https://hightimes.com/news/mississippi-legislator-brings-hemp-to-governors-office/">brought an ounce of hemp to the state governor</a> to demonstrate how little it is, and how much more medical patients could require to be properly treated for their ailments.</p>
<p><a href="https://hightimes.com/news/cannabis-flower-sales-begin-in-louisiana/">Sales for cannabis flower</a> in Louisiana only just began on January 1, 2022, finally bringing the reality of medical cannabis to patients in Louisiana after it was originally approved by legislators in 2015. Currently, patients with one or more qualifying conditions can received approval from their doctor to use medical cannabis.</p>
