<p>A limited-edition strain from an Oregon-based grower was named after U.S. Vice President Kamala Harris—and it ended up becoming the topic of a conversation on <em>Jimmy Kimmel Live</em>. The vice president has nothing to do with <a href="https://alibicannabis.com/kamala-kush/">Kamala Kush</a>, but was asked about the peculiar strain bearing her name while on live television.</p>
<p>In an <a href="https://www.youtube.com/watch?v=Ne3-KA8ja6g&amp;t=585s">interview</a> with late-night host Jimmy Kimmel on June 4, he brought up the topic of the proposal to move cannabis to Schedule III, and several other questions related to the topic. <em>Benzinga</em> <a href="https://www.benzinga.com/markets/cannabis/24/06/39212969/kamala-harris-gets-her-own-cannabis-strain-kamala-kush-whether-she-likes-it-or-not-watch-jimmy-k?comments_open=true">reports</a> that Harris appeared “visibly surprised upon learning that a cannabis strain had been named after her.”</p>
<p>“I think we both agreed people shouldn’t have to go to jail for smoking weed,” Harris said. “Well you don’t go to jail for drinking alcohol why would you go to jail for smoking. And so we’ve pardoned a number of people.”</p>
<p>She admitted resources are better spent on worse drug problems like fentanyl, and that it’s been determined that cannabis is not in fact a gateway drug.</p>
<p>“You know, I think it’s interesting also because, remember, there was a time when people would say, ‘well, marijuana is a gateway drug,’ and these were failed policies,” she said. “The resources should be better directed—and will be better directed—to deal with opioid addiction and what we need to do around fentanyl, getting more resources into mental health and mental health care.”</p>
<p>Kimmel confronted her about a strain in Oregon called Kamala Kush and asked her if she knew anything about it. </p>
<p>Laughing, Harris replied, “Really? Seriously? I did not know that.”</p>
<p>Clackamas, Oregon-based <a href="https://alibicannabis.com/who-we-are/">Alibi Cannabis</a>, is a woman-owned cannabis operation that created Kamala Kush. “So excited about this limited-run genetic,” Alibi Cannabis says about the strain. “Earthy and grounding. Buds are weighty and shaped like grenades. A unique flavor for an active high. Available only for a limited time!” Alibi Cannabis is available at dozens of OLCC-approved dispensaries throughout Oregon.</p>
<p>Kimmel also seemed surprised that the developers hadn’t sent Harris a sample. Even if they had, Harris said, “I’m not touching that.”</p>
<h2 id="kamala-harris-and-her-evolving-stance-on-cannabis" class="wp-block-heading"><strong>Kamala Harris and Her Evolving Stance on Cannabis</strong></h2>
<p>Alibi Cannabis appeared to be just as surprised about the mention on Jimmy Kimmel Live as everyone else, and acknowledged that she formerly served as a state prosecutor, which put her at odds with people who handle cannabis.</p>
<p>“Alibi produced a special edition strain called ‘Kamala Kush,’ the grower <a href="https://alibicannabis.com/jimmy-kimmel-chats-with-vp-harris-about-the-alibi-strain-named-kamala-kush/">posted</a> on their website. “In a wild turn of events, Jimmy Kimmel asked VP Harris about it. See her reaction! Would love to share with her our vision of a cannabis industry focused on helping people and providing high quality plant medicine.”</p>
<p>“We know her stance has been very negative towards the cannabis industry, but what better way of moving forward than to reach out and educate.”</p>
<p>Due to Harris’s history of having prosecuted some 2,000 cannabis-related offenders during her job as District Attorney of San Francisco in California, some people took her rescheduling announcement with a grain of salt.</p>
<p>But by 2019, Harris said that cannabis “gives a lot of people joy,” signaling that her views on the plant might be changing. In February 2019, Harris admitted in an interview on The Breakfast Club to smoking cannabis in college. “I have. And I inhaled—I did inhale. It was a long time ago. But, yes,” she <a href="https://www.cnn.com/2019/02/11/politics/kamala-harris-marijuana-legalization/index.html">said</a> in a reference to former president Bill Clinton’s famous “didn’t inhale” comment he said in 1992.</p>
<p>Last March, Harris <a href="https://hightimes.com/news/kamala-harris-to-host-white-house-weed-policy-reform-summit-with-fat-joe/">hosted a White House meeting</a> to discuss drug policy reform that will feature guests including hip hop artist Fat Joe and others who have benefitted from the cannabis pardons granted by the Biden administration. The Friday meeting will also include Kentucky Governor Andy Beshear, a leading proponent of cannabis legalization in his state, and other advocates for ending the criminal prohibition of cannabis. </p>

<p>On May 16, on the same day as President Joe Biden, Harris announced that it’s time to move cannabis to Schedule III, and posted a video with a speech about the game-changing move.</p>
<p>“President Biden and I vowed to address injustices in marijuana policy,” she said. “Today, our Administration takes another major step forward.”</p>
<p>“Currently marijuana is classified on the same level as heroin and more dangerous than fentanyl,” Harris said in another video. “We are finally changing that. But I want to thank all of the advocates and everyone out there for helping to make this possible and we are on the road to getting it done.” </p>
<p>Harris’s views are quickly changing, and the move to Schedule III could be a boost for the Biden administration with the general election quickly approaching this November.</p>

<p>Grammy and Emmy award-winning comedian and actress Tiffany Haddish is celebrating a new partnership between cannabis brand Cookies and the animated series <em>The Freak Brothers</em> that was marked by a 4/20 product launch in California. Haddish, who voices one of the characters in the show and serves as an executive producer, recently appeared at a Cookies dispensary in Los Angeles to kick off the collaboration. Entrepreneur and Billboard-charting rapper Berner, co-founder and CEO of the international cannabis and lifestyle brand, will join the show in future seasons of the animated series celebrating weed culture.</p>
<p>The Freak Brothers hit the cannabis scene in 1968 with the debut of the underground comic “The Furry Fabulous Freak Brothers” by creator Gilbert Shelton. The franchise, considered by many to be one of the most influential underground comics ever, soon became a counterculture hit, with more than 45 million comic books sold around the world. </p>
<p>In 2022, the Freak Brothers concept was translated into an animated series for the Fox streaming platform Tubi. In the television show, the protagonists Fat Freddy Freekowtski (voiced by actor John Goodman), Phineas T. Phreakears (Pete Davidson) and Franklin Freek (Woody Harrelson) are transported from the freewheeling 1960s to modern times after getting so high that they pass out for five decades. After waking up, still in their San Francisco basement apartment after 50 years, the Freak Brothers try to find their way in the seemingly futuristic setting, with highly hilarious results.</p>
<p>Haddish, who plays the brothers’ sassy cat Kitty, says the collaboration between Cookies and <em>The Freak Brothers</em> was a natural fit. </p>
<p>“The Freak Brothers is an old stoner comic book from the ‘60s and in the new show they smoke that good weed that transports them 50 years into the future,” Haddish said in an exclusive statement to <em>High Times,</em> “and we knew Cookies had that good weed that the Freaks would smoke so it was like BAM!”</p>
<h2 id="co-branded-lsd-joint-hits-store-shelves" class="wp-block-heading"><strong>Co-Branded ‘LSD Joint’ Hits Store Shelves</strong></h2>
<p>Last month, The Freak Brothers joined Cookies to celebrate the collaboration and launch of a new co-branded pre-roll dubbed the ‘LSD Joint,’ which hit store shelves just in time for 4/20. The launch also celebrated Berner’s upcoming addition to the star-studded cast of “The Freak Brothers” alongside Harrelson, Goodman, Haddish and Davidson. </p>
<p>“We felt like ‘LSD Joint’ was an appropriate name for our collab given the Freak Brothers are from the ’70s, from San Francisco, and this joint is EXTREMELY strong,” Berner said in a statement about the collaboration, adding “I love that the animated show is so weed-friendly and done with class. I’m incredibly excited to announce that I am joining the Freak Brothers show alongside an epic cast.”</p>
<p>Greg Goldner, head of brand and strategy for Freak Brothers, says the new collaboration with Cookies celebrates the two brands’ shared heritage.</p>
<p>“This is the first-ever official cannabis product for ‘The Freak Brothers,’ so we wanted to lean into the cool trippy Bay Area heritage shared by both brands while producing a product the Freaks themselves would have loved to spark up,” Goldner said in a statement to the press.</p>
<p>“From the intricate details of the engraved, reusable wood tips to the vibrant, psychedelic designs of the package, every aspect of this collaboration perfectly captures the creative ethos both ‘The Freak Brothers’ and Cookies are renowned for,” Goldner added.</p>
<p>Haddish says she leaned into the partnership when she heard about the exclusive cannabis products planned for the collaboration.</p>
<p>“Berner and the Cookies team talked to the Freak Brothers team to come up with something cool, and once I knew there was going to be a marijuana line, I said let’s do this because she ready over here – and we just getting started,” said Haddish.</p>
<p>The first two seasons of <em>The Freak Brothers</em> are currently streaming for free on Tubi. The show is executive produced by Courtney Solomon and Mark Canton, along with award-winning showrunners Alan Cohen and Alan Freedland. Haddish, Harrelson, Davidson, Shelton and Manfred Mroczkowski also serve as executive producers of the series. </p>
<p>“We’re excited to welcome Berner to the show. His proven track record of innovation and his authentic love of cannabis culture is a perfect marriage with the Freak Brothers,” said Courtney Solomon, Freak Brothers’ CEO and show executive producer. “We look forward to a long collaboration together.” </p>
<p>Season 3 of <em>The Freak Brothers</em> animated series is currently in the works, although a release date for new episodes has not yet been announced.</p>

<p>The U.S. House of Representatives this week passed a bill that would permit cannabis advertising on broadcast television and radio stations. The legislation is included as part of the Fiscal Year 2023 Financial Services and General Government appropriations bill, which was passed by lawmakers in the House on Wednesday.</p>
<p>Under the provisions of the <a href="https://docs.house.gov/meetings/AP/AP00/20220624/114951/BILLS-117-FC-AP-FY2023-AP00-FSGG-U1.pdf">appropriations bill</a>, the Federal Communications Commission (FCC) would be barred from using appropriated funds to deny a broadcaster a license renewal or sale application for airing cannabis advertising in jurisdictions that have legalized marijuana. The FCC would also be prohibited from requiring a station to file an early license renewal application for broadcasting cannabis ads.</p>
<p>Current regulations allow the FCC to revoke a license from broadcasters that air advertisements for federally illegal products including weed, even in states that have passed laws legalizing cannabis. As a result, cannabis businesses are limited to advertising in other forums including print newspapers and magazines, online, billboards, cable <a href="https://hightimes.com/culture/8-cant-miss-weed-centric-television-episodes/">television</a>, satellite radio, and social media. Alex Siciliano, a spokesman for the National Associations of Broadcasters, said on Wednesday that the legislation passed in the House this week levels the playing field for cannabis advertising.</p>
<p>“For too long, local broadcasters have been stuck in a regulatory purgatory because of conflicting federal and state cannabis laws,” <a href="https://www.nab.org/documents/newsRoom/pressRelease.asp?id=6514">Siciliano said</a> in a statement. “Today’s passage marks an important step towards allowing broadcasters to receive equal treatment for cannabis advertising that many other forms of media have enjoyed for years. While we are pleased to see the House act, broadcasters will continue to work with policymakers for a permanent resolution to this competitive disparity to the benefit of consumers.”</p>
<h3 id="broadcasting-groups-applaud-legislation"><strong>Broadcasting Groups Applaud Legislation</strong></h3>
<p>The spending bill was passed by the House Appropriations committee in June. The legislation gives broadcasters access to the growing market for cannabis advertising, which is expected to total $18.5 billion this year alone.</p>
<p>“We are pleased to see that this bipartisan language has advanced in the House today,” <a href="https://www.mediapost.com/publications/article/375161/house-committee-moves-to-protect-local-broadcaster.html">Siciliano said</a> in a statement late last month. “As the vast majority of states have legalized cannabis in some form, today marks a long overdue step toward finally allowing broadcasters to receive equal treatment regarding cannabis advertising that other forms of media have had for years.”</p>
<p>David Donovan, president of the New York State Broadcasters Association (NYSBA), thanked lawmakers in the House “for recognizing the unfairness of the present situation with respect to cannabis advertising.”</p>
<p>“The provision in this House appropriations bill is a major step forward for leveling the playing field for local broadcasters,” <a href="https://adage.com/article/marketing-news-strategy/cannabis-ads-may-soon-be-allowed-local-tv-radio/2422106">Donovan said</a> in a statement from the broadcasting industry group. “We believe the law of the state in which a station is licensed should determine whether a station can accept cannabis advertising if they so choose. We look forward to working with members of Congress and the Administration to help restore parity between local broadcasters and other media outlets.”</p>
<p>“We believe the law of the state in which a station is licensed should determine whether a station can accept cannabis advertising if they so choose,” Donovan added. “We look forward to working with members of Congress and the Administration to help restore parity between local broadcasters and other media outlets.”</p>
<p>Before the bill becomes effective, it must still be passed by the Senate and signed into law by President Joe Biden. The NYSBA noted that gaining Senate approval for the legislation may be a challenge.</p>
<p>“The appropriations process is notoriously complex, which means the bill may get stalled. Congress is likely to adopt an interim budget through a continuing resolution. At some point, perhaps after the mid-term elections, there will be a final vote. Even if it passes, the legislation is not a ‘silver bullet.’”</p>
<p>Because the cannabis advertising provisions were passed as part of an annual appropriations bill, the prohibition on the FCC taking action against broadcasters for airing weed ads would only be in effect for one year, beginning on October 1. For the marijuana advertising terms to continue, the appropriations language must be reauthorized each year.</p>

<p>New York state regulators voted on Wednesday to approve draft rules for the packaging and marketing of legal cannabis products. The proposed regulations establish parameters for the sale of recreational weed products, which are expected to go on sale by the end of the year following the legalization of adult-use cannabis by state lawmakers in 2021.</p>
<p>Under the <a href="https://cannabis.ny.gov/system/files/documents/2022/05/draft-packaging-and-labeing-marketing-advertising-part-128-and-129-regulations.pdf">draft regulations</a> from the New York Cannabis Control Board, companies will be permitted to advertise their products via television, radio, social media and other platforms. But the rules also include strict provisions designed to protect children from being influenced by cannabis marketing.</p>
<p>“Protecting public health, reducing harm and promoting sustainable industry practices are key components of legalizing cannabis for adult use and I look forward to considering these regulations as we develop the industry,” Cannabis Control Board Chair Tremaine Wright <a href="https://nypost.com/2022/06/01/new-york-spells-out-marketing-packaging-rules-for-legal-marijuana-sellers/">said in a statement quoted</a> by the <em>New York Post</em>. “We are committed to building a New York cannabis industry that sets high standards for protecting children and keeping products safe and sustainable.”</p>
<h3 id="rules-designed-to-protect-kids"><strong>Rules Designed To Protect Kids</strong></h3>
<p>Labels for cannabis products must include the serving size, potency, ingredients, and directions for usage and storage. Packaging and advertising that contain cartoon characters, bubble lettering, neon colors, references to candy, or other elements likely to <a href="https://hightimes.com/news/fda-sounds-alarm-about-cereal-and-candy-edibles-that-appeal-to-children/">appeal to people younger than 21 years old</a> are not allowed.</p>
<p>The regulations also forbid the use of endorsements from celebrities who appear to be younger than 21 and ban the use of common terms in the cannabis culture lexicon including “weed,” “pot,” “stoner,” and “chronic.” Misleading claims of health benefits and indications that the product is “safe” or “organic” are also prohibited, as are actual images of marijuana or people vaping or smoking.</p>
<p>Katrina Yolen, chief marketing officer of multistate cannabis operator Acreage Holdings, applauded New York regulators for updating the guidelines for cannabis marketing and advertising in advance of the launch of adult-use sales.</p>
<p>“Recognizing that cannabis operators need to be able to communicate better with consumers to educate, inform and build awareness about the benefits of cannabis is vital for the state and industry,” Yolen wrote in an email. “We look forward to supporting and working with the Office of Cannabis Management on the final guidelines over the coming weeks.”</p>
<p>All cannabis product packaging must include the state symbol of approval that includes the universal cannabis symbol with a cannabis leaf and the letters “THC,” plus an indication that the product is for consumers 21 and up and the New York state logo. The stipulated label is reserved for products that have been produced by licensed cannabis companies and lab tested for safety in accordance with state law.</p>
<p>Packaging for cannabis products must also be child-resistant, meeting standards that make the product difficult for a child younger than 5 to open. Additionally, the regulations require that cannabis advertising be no closer than 500 feet to schools, libraries, daycare centers, and playgrounds.</p>
<p>The draft regulations also call for a rotating series of warning labels to be placed on packaging for cannabis requirements, such as “Cannabis can impair concentration, coordination and judgment. Do not operate a vehicle or machinery under the influence of cannabis” and “Keep out of reach of children and pets.” </p>
<h3 id="marketing-rules-set-a-high-bar-in-new-york"><strong>Marketing Rules Set a High Bar in New York</strong></h3>
<p>The regulations forbid marketing and promotional tactics commonly used by companies in other industries. Price promotions, coupons, customer loyalty programs, and other discounts are not allowed under the rules.</p>
<p>In an email to <em>High Times, </em>Katelin Edwards, senior regulatory analyst at Simplifya, a regulatory and operational compliance software platform serving the cannabis industry, said that a particular aspect of New York’s regulations may prove to be especially burdensome for weed businesses.</p>
<p>“Although it is true that a NY cannabis licensee can advertise cannabis products, cannabis paraphernalia, or goods or services related to cannabis or cannabis products by means of television, radio, print, internet, mobile applications, social media and other electronic communication,” said Edwards, “the licensee has to have reliable evidence that at least 90%, unless otherwise determined by the Office, of the audience for the advertisement is reasonably expected to be twenty-one years of age or older.”</p>
<p>Edwards notes that the composition requirement is more stringent than most states that have legalized recreational pot, including Colorado, California, and New Jersey, where audience composition requirements that call for about 70% of the audience to be 21 and older are the norm.</p>
<p>“Getting reliable and up-to-date audience composition data to prove that at least 90% of the audience is reasonably expected to be 21 years of age or older may be challenging; especially when ‘reasonably expected’ is so ambiguous and the burden of proof is on the licensee.”</p>
<p>The new proposed regulations will now undergo a 60-day public comment period beginning on June 15 before coming up for a final vote by the board.</p>
